Questions (EXECUTIVE ORDER NO. 264)

Executive Order No. 264 cites Section 4, Article XVI of the 1987 Constitution (Armed Forces composed of a citizen armed force, subject to training and service) and Section 4, Article II (prime duty of government to serve and protect people; government may call upon citizens to defend the State, with conditions provided by law).

The CAF includes all reservists, and officers and enlisted men on inactive status.

All able-bodied citizens are required to undergo military training.

They become reservists with appropriate ranks.

Reservists in a particular locality are organized into reserve geographical units subject to call and mobilization as needed, individually or as a unit.

Reservists called to active duty shall serve with the regular troops as part of the standing force.

The Secretary of National Defense shall prescribe and implement a continuing program of recruitment and training for the CAF.

The Secretary of National Defense shall cause the organization of the CAF into Geographical Units (CAF GUs) throughout the country and implement the reserve force development program of the Armed Forces of the Philippines.

It consists of a cadre of officers and men in the active force and qualified reservists residing in the locality.

Yes. The cadre may be assigned to another unit in the active force while the CAF GU to which they are assigned is on inactive status.

Whenever dictated by military necessity, upon recommendation of the Secretary of National Defense and approved by the President.

They are part of the CAF GUs, constituted out of volunteers screened in consultation with local executives and civic/business leaders; they mean a degree of activation short of full active duty status; and they are not vested with law-enforcement or police functions.

They are subject to military law and the Articles of War.

Funds necessary to implement the EO shall be taken from the applicable appropriation of the Department of National Defense.

The Secretary of National Defense must promulgate the necessary rules and regulations to implement the EO, subject to approval by the President.

Yes. It states that all laws, orders, rules and regulations, or parts thereof inconsistent with the EO are repealed or modified accordingly.

It takes effect after ninety (90) days following completion of its publication in the Official Gazette or in a newspaper of general circulation in the Philippines.

The CAF may complement operations of the regular force or support regular force formations/units when military necessity arises and leadership approval requirements are met.
