Conversion of the Kabasalan Institute
- The Kabasalan Institute of Technology in the Municipality of Kabasalan, Province of Zamboanga Sibugay is converted into a polytechnic institute.
- The converted polytechnic institute is known as the Zamboanga Sibugay Polytechnic Institute (ZSPI).
- The ZSPI operates under the supervision and administration of the Technical Education and Skills Development Authority (TESDA) (Section 2).
General mandate and training mission
- The ZSPI shall restructure technical-vocational curricular programs to be responsive to rapidly changing industry and labor-market demands in both domestic and global fronts (Section 3).
- The ZSPI’s curricular and program development shall operate within the context of the Philippine Qualifications Framework (PQF), the Senior High School Program of the Department of Education (DepED), the ASEAN economic integration framework, and other relevant international agreements for technical-vocational education (Section 3).
- The ZSPI shall pursue higher level competency qualifications in technical-industrial education programs and technology and shall upgrade curricular standards as a tertiary TESDA-polytechnic institution (Section 3).
- The ZSPI shall offer one (1)-year to three (3)-year TESDA-registered technical-vocational curricular skills training programs and certificate courses.
- The ZSPI shall aim to meet competency requirements under Level V of the PQF, which is the Diploma Level in technical-vocational education (Section 3).
- The ZSPI shall primarily provide tertiary undergraduate technical-vocational education and shall also provide skills trainings and trade specialization courses geared toward employable skills, gainful employment, practical livelihood, and entrepreneurship (Section 3).
- The ZSPI shall play a lead role in helping students, out-of-school youths, and residents from low-income families and persons with disabilities from the Municipality of Kabasalan and adjacent municipalities become productive, self-reliant, and part of a globally competitive middle to high-level skilled labor force to hasten social and economic development in the province (Section 3).
- The ZSPI shall design training programs by considering competency assessment of the socioeconomic profile, employment conditions and opportunities, business climate, market and industry potentials, available resources, and presence of support structures, including literacy level and skills readiness, and the overall development needs of the host area and adjacent communities within its operational radius (Section 3).
- The ZSPI shall consider relevant skills and trade competencies, craftsmanship training programs, and entrepreneurship activities needed for effective employment and development interventions to build human resource and economic productivity hubs in Kabasalan and other localities within the province (Section 3).
- The ZSPI shall serve as a TESDA-accredited Assessment Center for acquired competencies in technical-vocational skills in the entire Province of Zamboanga Sibugay (Section 3).
- Priority admission and availment of technical-vocational education, including scholarships, grants-in-aid, and student financial assistance, shall be given to the most disadvantaged citizens of the Municipality of Kabasalan and to the most economically depressed areas in the province (Section 3).
- In coordination with the DepED and TESDA, the ZSPI shall render relevant teachers’ training assistance and curriculum design to secondary schools offering the TVL track under the K to 12 Program within its operational radius where deemed necessary and practicable (Section 3).
Curricular offerings and training programs
- The ZSPI shall offer one (1)-year to three (3)-year technical-vocational courses and undergraduate certificate, including short-term courses and modular trainings in diverse relevant technical-vocational and industrial technology education to comply with employment standards in preferred market-driven labor opportunities (Section 4).
- The ZSPI shall focus on skills specialization for local market employment requirements to support development of a robust inclusive economy of the Municipality of Kabasalan and other municipalities in the Province of Zamboanga Sibugay, in coordination with the Department of Labor and Employment (DOLE), Department of Trade and Industry (DTI), Department of the Interior and Local Government (DILG), National Economic and Development Authority (NEDA), business-industry partners, and other relevant agencies (Section 4).
- The ZSPI may establish research and technology hubs, mobile training programs, and satellite or extension training centers in priority areas throughout the Province of Zamboanga Sibugay to strengthen industry-academe-technology linkages (Section 4).
- The ZSPI shall adopt innovative training modes such as information technology-assisted instruction, dual learning system, open or distance education, and community laboratory and other instructional programs to increase community access to technical-vocational education and skills training (Section 4).
- The ZSPI shall offer TESDA-registered technical-vocational courses and short-term training programs as far as necessary and practicable (Section 4).
- Course completion in these programs shall be credited through skills competency assessment under National Certification (NC) Levels I to V, as applicable, and shall further qualify for academic recognition under the Ladderized Interface System for tertiary education if compliant with the requirements of that program (Section 4).
- The ZSPI shall offer skills development options for higher competency qualifications in technical-industrial education, trade technology, tourism, agricultural technology, business literacy, and innovation in TESDA-registered skills courses (Section 4), including the following categories:
- (a) Industrial education and technology, including training in industrial trades such as metal and steel works, machine fabrication, heavy equipment operations, automotive mechanic, refrigeration and air conditioning, electronics, and operation of power tools and equipment for both light grade use and industrial purposes (Section 4).
- (b) Tourism and hospitality-related courses relating to hotel, restaurant, and tourism development management, including social communication skills training and language proficiency courses in English and other languages for business outsourcing employment and overseas job placement (Section 4).
- (c) Livelihood skills development courses for small-scale income generating opportunities and entrepreneurship training, including practical skills education in crafts and arts, workmanship and designing (fabric, woodworks, jewelry and metal works), agriculture and farm technology, backyard gardening and propagation, horticulture, home-based aquaculture, livestock raising, food processing technology, home technology, culinary arts, beauty culture, health and wellness trainings (Section 4).
- (d) Basic business literacy training in financial management and marketing, practical accountancy, bookkeeping and office procedures, business processes and application procedures including registration, licensing, documentation, business patent and intellectual property regulation, business financing and investment opportunities sourcing, including online home-based business (Section 4).
- (e) Agriculture and aquaculture-related trainings and skills development such as farming-fishing operations technology, backyard farming and home-based aquaculture and propagation innovations, mechanized farm and fishing tools and equipment operation, agribusiness, agri-aqua trade technology and innovations, and relevant farmers and fisherfolk continuing trainings for increased productivity and entrepreneurship (Section 4).
- (f) Technical-vocational occupation such as carpentry, masonry, plumbing, practical electricity, automotive technician and servicing, electronics technician and servicing, welding technician, personal computer (PC) servicing, and other relevant technical skills courses (Section 4).
- (g) Computer literacy and IT-related skills, including digital technology, web design, photoshop/online photography, computer design and advertising (Section 4).
- (h) Seminars in personality development, career counseling and job placement, work ethics and values (Section 4).
- (i) Other preferred priority skills needed by the people of Kabasalan and relevant to the needs of other service areas in the Province of Zamboanga Sibugay to enhance practical livelihood, gainful employment, and entrepreneurship skills (Section 4).
TESDA compliance as condition to operate
- The conversion becomes operationally effective only after TESDA issues a formal recommendation and a Certificate of Compliance confirming satisfactory compliance with TESDA minimum requirements and quality standards (Section 5).
- TESDA compliance must cover:
- (a) Standard procedures and guidelines (SPGs) for the establishment, conversion, and operation of TESDA polytechnic institutes of technical education and TESDA technology institutions (Section 5).
- (b) Operational sustainability in terms of licensed faculty/trainors and personnel, equipment, training and laboratory facilities, instructional materials, and other standard requirements as a TESDA-accredited center (Section 5).
- (c) Sustainable funding source and allocation of the budget requirement of the TESDA polytechnic institute established under the Act (Section 5).
- (d) Training program alignment with minimum competency-based quality technical-vocational skills technology standards and the needs of the host municipality (Kabasalan) and adjacent areas served, within the PQF and ASEAN framework for technical-vocational education (Section 5).
- (e) Other TESDA conditionalities necessary and applicable for conversion into the ZSPI (Section 5).
Administration and head of the institute
- The ZSPI is headed by a School Superintendent under TESDA supervision.
- The TESDA Director General appoints the School Superintendent in accordance with civil service rules and regulations and qualification requirements and standards for the office (Section 6).
- The School Superintendent renders full-time services and is responsible for the administration and operation of the ZSPI (Section 6).
- The institute’s academic and administrative staff shall follow the TESDA staffing pattern for this type of schools pursuant to existing laws, rules, and regulations (Section 6).
Assets, liabilities, and personnel transfer
- All assets (fixed and movable), personnel, records, and documents of the Kabasalan Institute of Technology, and its liabilities or obligations, are transferred to the ZSPI (Section 7).
- Faculty and personnel positions, rights, and security of tenure employed under existing laws before conversion are not impaired (Section 7).
- All government parcels of land occupied by the Kabasalan Institute of Technology are declared property of the ZSPI and must be titled in the name of the ZSPI (Section 7).
- If the ZSPI ceases to exist or if those parcels are no longer needed by the ZSPI, the parcels revert to the concerned LGU or to the Municipality of Kabasalan, Province of Zamboanga Sibugay (Section 7).
Appropriations for implementation
- Implementation of the Act is initially funded by charging the needed amount against the current year’s appropriations of the Kabasalan Institute of Technology (Section 8).
- After initial implementation, the amount necessary for operating the ZSPI is included in the annual General Appropriations Act (Section 8).
Implementing rules and timelines
- TESDA shall, within ninety (90) days after Act approval, prepare and issue necessary rules and regulations for effective implementation.
- TESDA issues the rules and regulations in coordination with DOLE, DTI, Department of Budget and Management (DBM), DILG, concerned LGUs, and other relevant agencies and industry-business partners of the host locality (Section 9).
Separability and repeal rules
- If any section of the Act is unconstitutional or invalid, the remaining sections or provisions remain in force and effect (Section 10).
- All laws, executive orders, decrees, instructions, rules, and regulations contrary to or inconsistent with any provision of the Act are repealed or amended accordingly (Section 11).
