Curricular Offerings and Mandate
- The WVSU-HCC must offer undergraduate and graduate degree programs in advanced education, higher technological, professional instruction and training, and arts, science and technology.
- The WVSU-HCC must also offer short-term technical-vocational education and training (TVET) and other related and relevant fields of study within its areas of specialization to meet provincial and regional needs.
- The WVSU-HCC must undertake research, extension services, and production activities in support of the socioeconomic development of the province and the region.
- The WVSU-HCC must provide progressive leadership in its areas of specialization.
- The WVSU-HCC must retain its original primary mandate as an arts and science institution.
- The WVSU-HCC must offer master’s and doctorate degree programs and courses related to food production.
Governing Board and University Policies
- Governance of the WVSU-HCC is vested exclusively in the Board of Regents (BOR) created under Presidential Decree No. 2019 and Republic Act No. 8292 that governs the WVSU.
- All policies, rules, and regulations approved by the WVSU-BOR apply to the WVSU-HCC.
Campus Administrator: Appointment and Limits
- Administration of the WVSU-HCC is the responsibility of the Campus Administrator.
- The Campus Administrator is appointed by the WVSU President and confirmed by the BOR.
- The Campus Administrator must serve on a full-time basis.
- The Campus Administrator serves for a term of two (2) years and is eligible for reappointment for another term.
- The Campus Administrator must be no older than sixty-two (62) years old at the time of appointment to qualify for reappointment or term extension.
- The Campus Administrator must not have reached the age of sixty-five (65) years old.
- The Campus Administrator must have at least an academic rank of associate professor and at least three (3) years of experience as Department Chair, Director or Vice President of a College/Unit.
- If the Office becomes vacant due to death, compulsory retirement, resignation, removal for cause, or incapacity, the WVSU President designates a new Campus Administrator.
Campus Administrator: Powers and Representation
- The Campus Administrator’s powers and duties are similar to the powers and duties of Campus Administrators in other WVSU campuses.
- The Campus Administrator represents the WVSU-HCC in both the Administrative Council and the Academic Council of the University.
Compliance with CHED Requirements
- The establishment of the WVSU-HCC ensures that minimum requirements for operation and program offerings have been complied with as prescribed by the Commission on Higher Education (CHED).
University Charter and Governing Framework
- Republic Act No. 8292 (the “Higher Education Modernization Act of 1997”) forms an integral part of this Act.
- Republic Act No. 8292 and this Act together serve as the governing charter of the University.
Additional University Powers under Existing Law
- All powers, functions, privileges, responsibilities, and limitations to state universities and/or their officials under existing laws are deemed granted to or imposed upon the University and/or its officials whenever appropriate.
Transfer of Assets, Liabilities, and Personnel
- All assets, real and personal properties, personnel, and records of the WVSU-Extension in Himamaylan City, together with all liabilities or obligations, are transferred to the WVSU-HCC.
- The positions, rights, and security of tenure of faculty members and personnel employed under existing laws prior to the conversion are respected.
- All parcels of land belonging to the government occupied by the WVSU-Extension in Himamaylan City are transferred to the WVSU-HCC.
- The transferred parcels must be titled under the name of the WVSU-HCC.
- If the campus or the University ceases to exist, is abolished, or if the parcels of land are no longer needed by the University, the parcels revert to the local government units concerned.
Funding and Appropriations Arrangements
- The amount necessary for initial implementation of this Act is charged against the current year’s funding of the WVSU-Extension provided by the City of Himamaylan, Negros Occidental.
- The City of Himamaylan must continue to provide the same funding to the WVSU-Extension School corresponding to the funding given before integration into the WVSU.
- The City’s continued funding applies until the full funding requirement of the WVSU-HCC is included in the annual General Appropriations Act.
Timetables for Planning and Structure
- Within one hundred twenty (120) days after approval of this Act, the WVSU-HCC must accomplish the following:
- Submit a five (5)-year development plan including its corresponding program budget to CHED for recommendation to the Department of Budget and Management.
- Undergo a management audit in cooperation with CHED.
- Set up its organizational, administrative, and academic structure, including the appointment/designation of WVSU-HCC officials.
- Initiate the establishment of at least two (2) separate degree-granting units, one in arts and sciences and another at the graduate level.
Implementing Rules and Regulations
- Within ninety (90) days from approval of this Act, the Board of the WVSU must promulgate the rules and regulations to implement its provisions.
- The rules must be promulgated in consultation with CHED.
- The implementing rules and regulations take effect thirty (30) days after the effectivity of this Act.
Separability, Repeal, and Effectivity
- If any provision of this Act is declared unconstitutional, the remainder of this Act remains in full force and effect.
- All parts of Presidential Decree No. 2019 and other laws or parts thereof inconsistent with this Act are deemed repealed or modified accordingly.
- This Act takes effect fifteen (15) days after its publication in the Official Gazette or in any newspaper of general circulation.
