Policy intent and economic rationale
- The upgrading of the Ports of Limay and Mariveles is intended to complement efforts to accelerate the total development of Bataan and its outlaying Special Economic Zone.
- Upgrading enables the port to avail of manpower complement and resources from national government agencies, including the Bureau of Customs, to hasten infrastructure and systems development.
- The Executive Order is premised on the need for enhanced port status to support expanded economic activity within the port.
- The Executive Order is directed toward attracting more investors and other locators by strengthening port capabilities.
Port upgrade: Principal Port of Entry
- The existing Ports of Limay and Mariveles are opened and declared as a principal port of entry to be known as the District Port of Limay and Mariveles (Section 1).
- The District Port of Limay and Mariveles is the customs port framework resulting from the upgrade (Section 1).
- The upgrade grants principal port status to both ports jointly within the new district structure (Section 1).
Customs collection district jurisdiction and coverage
- The Commissioner of Customs, subject to the approval of the Secretary of Finance pursuant to Section 701 of the Tariff and Customs Code of the Philippines (TCCP), as amended, is authorized to redefine the jurisdictional boundaries of the Port of Manila and delineate the jurisdictional limits of the new principal port of entry (Section 2).
- The new principal port of entry becomes Customs Collection District No. XVI, known as the District Port of Limay and Mariveles (Section 2).
- Collection District XVI has jurisdiction over the entire province of Bataan and such other areas as may be added by the Commissioner of Customs (Section 2).
- Collection District XVI excludes the area covered by the SBMA-Bataan created under Republic Act No. 7227, Proclamation No. 984, Executive Order No. 381, and other laws appurtenant thereto (Section 2).
- The Port of Mariveles functions as a Sub-port under Collection District No. XVI (Section 2).
Port leadership and designated customs officials
- Collection District XVI (District Port of Limay and Mariveles) is headed by a Customs Collector V (Section 3).
- Collection District XVI is assisted by Deputy Collectors of Customs designated by the Commissioner of Customs (Section 3).
- The Sub-port of Mariveles is headed by a Port Collector (Section 3).
- The Sub-port of Mariveles is assisted by Deputy Collectors of Customs designated by the Commissioner of Customs (Section 3).
Implementing authority and personnel rules
- Subject to the approval of the Secretary of Finance, the Commissioner of Customs is authorized to determine the personnel requirements of the District Port of Limay and Mariveles (Section 4).
- In determining personnel requirements, the Commissioner must take into account the principles of economy, efficiency and effectiveness (Section 4).
- The Commissioner may issue orders, subject to applicable Civil Service rules and regulations, to effect transfer or movement of personnel from any organizational unit of the Bureau of Customs involved in the District Port of Limay and Mariveles (Section 4).
- The Commissioner may create new positions for the District Port of Limay and Mariveles, subject to applicable Civil Service rules and regulations (Section 4).
- The new personnel complement is deemed integrated in the Bureau’s Rationalization Plan (Section 4).
Funding and operational appropriations
- Funds for the initial operations of the District Port of Limay and Mariveles are drawn from the available funds of the Bureau of Customs (Section 5).
- Subsequent appropriations are incorporated into the District Port’s budget proposals (Section 5).
- Funding and budget proposals are subject to existing budgeting, accounting, and auditing laws and procedures (Section 5).
