Legal basis and predecessor ordinances
- The ordinance is anchored on Metro Manila Council action adopting a uniform ticketing framework through MMDA Resolution No. 12-02.
- It is based on MMDA Resolution No. 12-20, which approves and adopts the Uniform Ticketing System (UTS) harmonized fines and penalties recommended by a Technical Working Group (TWG) and endorses the same to local councils for adoption.
- The ordinance revises/modifies Muntinlupa’s prior traffic code through Ordinance No. 04-022, known as the Traffic Code of the City of Muntinlupa, as amended by Ordinance No. 08-070 and Ordinance No. 09-081.
Policy and purpose statement
- The ordinance recognizes that the existing traffic ticketing system and uncoordinated implementation of traffic laws cause confusion among the driving public and lead to loss of money and productive hours.
- It recognizes that unattended traffic-law enforcement issues may create chaos to the detriment of the public.
- It adopts the TWG’s recommended uniform traffic fines and penalties to harmonize existing national and local traffic ticketing laws in Metro Manila.
Uniform traffic penalties adopted
- The ordinance adopts the Uniform Ticketing System Harmonized fines and penalties enumerated for traffic violations in Section 2.
- The adopted penalties apply as “Agreed Single Penalty” amounts, including cases where the schedule adds impoundment, towing fees, seminar, or driver-license consequences.
- Other restrictions are penalized depending on the violation committed.
- The schedule provides specific penalties for each enumerated traffic and regulatory offense category, including driver conduct, vehicle requirements, parking rules, public order discharges, and franchise-related violations.
Core penalty schedule (Section 2)
- General Driving Rule violations carry PHP 500.00 for:
- Keeping as Far Right as Practicable, Overtaking, Use of Center Lanes of Three Lanes thoroughfares, Passing vehicles, Giving way to overtaking vehicles, Drivers not to obstruct traffic, Driving in lanes on thoroughfares, Driving through Roundabouts and Rotondas, Keeping right of double Yellow Lanes, Driving in Bicycle Lanes, Driving in reserved lanes, and Driving over a Yellow Box.
- General Driving Rule additional PHP 500.00 items include: Driving in lanes on thoroughfares, Driving through Roundabouts and Rotondas, and other listed maneuvers and lane discipline entries at PHP 500.00 each.
- Specific offenses with higher penalties include:
- Driving, under the influence of Liquor or Drugs: PHP 2,500.00.
- Driving without license: PHP 1,000.00 and impoundment.
- Discrimination of passengers/trip cutting: PHP 1,000.00.
- Kabik System: PHP 2,500.00 + recommendation of cancellation of franchise.
- Overloading (Exceeding Gross Weight, Axia and Wheel Load): PHP 1,000.00.
- Driving vehicle with Fake Driver’s License: PHP 2,000.00 + impounding.
- Reckless Driving: PHP 2,000.00 + seminar.
- Unauthorized Drag Racing/Speed Contest: PHP 2,000.00.
- Illegal Counterflow: PHP 2,000.00 + seminar.
- Violation of Speed/Drag Racing Contests: PHP 2,000.00 + impounding and seminar + suspension of DL (with escalating license consequences: (1st off. + recommendation for suspension for 3 months, 2nd + 6 months) (3rd + revocation of DL)).
- License plate and equipment display penalties include:
- No holding to handle bar (Human powered/bicycles/pedicabs): PHP 200.00; Motorized, electric moped: PHP 2,000.00.
- No ID’s displayed: PHP 500.00.
- Plates Not Firmly Attached & Visible: PHP 1,000.00.
- Dirty or Uncared for Plates: PHP 300.00.
- Inconspicuously Displayed Plates: PHP 2,500.00.
- Improper Display of Plates: PHP 2,500.00.
- Using Expired/Delinquent plates: Used of Expired Commemorative, License Plates, etc.: PHP 2,500.00.
- Bicycle, tricycle, and helmet/seatbelt-related penalties include:
- No Safety Helmet for motorcyclist: PHP 500.00 (the driver will be the only one to be apprehended).
- Non-use of seatbelts: PHP 250 + (R.A. 8750 (D) (P)).
- Improper riding of bicycle or tricycle: PHP 500.00.
- Driving Tricycle on National Road: PHP 500.00.
- Improper Uniform: PHP 150.00.
- Riding Bicycle and Tricycle without regular and permanent seat: PHP 400.00.
- Overloading of passengers of bicycles and tricycles: PHP 500.00.
- Operating animal drawn carriages, bicycle and tricycle without license (without permit): PHP 1,000.00.
- Parking penalties include:
- Parking and waiting in prohibited areas: PHP 400.00.
- Parking near grade or curve: PHP 500.00.
- Parking on parade routes and on any special occasions: PHP 500.00.
- Parking for certain prohibited purposes: PHP 400.00.
- Parking in front residential or of commercial establishment: PHP 400.00.
- Violation in Parking Areas: PHP 500.00 + towing fee.
- Public conduct and sanitation penalties include:
- Smoking Ban: 1st PHP 1,000.00; 2nd PHP 2,000.00; 3rd PHP 3,000.00 + imprisonment.
- Smoke Belching: 1st PHP 1,000.00; 2nd PHP 2,000.00; 3rd PHP 3,000.00.
- Urinating/Defacating/Spitting: PHP 500.00.
- Littering: 1st PHP 150.00; 2nd PHP 300.00; 3rd PHP 500.00.
- Illegal Dumping and Disposal of Garbages: PHP 1,000.00.
- Driving regulation and signaling penalties include:
- Disobedience to Traffic Control Signals: PHP 500.00.
- Disobedience to Signs: PHP 500.00.
- Improper use of horns, warning instruments: PHP 500.00.
- Violation of No Left Turn, No Right Turn: PHP 500.00.
- Violation of One-way Street: PHP 2,000.00.
- Violation of No Entry Sign: PHP 2,000.00.
- Violation of Stop Sign: PHP 500.00.
- Violation of Give Way/Yield Sign: PHP 500.00.
- Violation of No U-Turn Sign: PHP 500.00.
- Violation of Speed Limits: PHP 1,000.00.
- Traffic accident-related procedure penalties include:
- Following fire trucks and other emergency vehicles: Increase to PHP 1,000.00 due to gravity of offense.
- Violation of procedures involving Traffic Accidents: PHP 2,000.00.
- Parking/stopping and towing fees are expressly set as part of the ticketed schedule, including:
- Towing Fee: Type A vehicle (not more than 4,000 kgs.): PHP 1,500.00; Type B (more than 4,000 kgs.): PHP 2,000.00; Type C: PHP 2,500.00.
- Additional towing-fee entries specify distance and conditions for some local ordinance items: towing fee (3kms.) a empty tank, towing fee (4kms) a empty tank, and towing fee (5kms) a empty tank.
- Franchise, route, and fare-matrix compliance penalties include:
- No franchise/CPC/PA Carried: PHP 500.00.
- Out of route (PUB/PUJ): PHP 2,500.00 + impounding.
- Out of service area (Tricycle/Pedicab): PHP 1,000.00.
- Overcharging of Fares/contracting services: PHP 1,000.00.
- No fare matrix displayed: PHP 500.00.
- No Business and Trade Name: PHP 300.00.
- Breach of Franchise Condition: PHP 2,500.00.
- Colorum Operations: PHP 2,500.00 + impounding for Colorum Operations of Cargo & Passenger Vehicle.
- Document/registration/ID display penalties include:
- Failure to carry/show/surrender Driver’s License: PHP 1,000.00 + impoundment.
- Driving outside Bicycle Lane: PHP 200.00.
- Failure to carry/show/registration: PHP 300.00.
- Expired Driver’s License: PHP 1,000.00 + impounding.
- Expired Registration: PHP 1,000.00.
- Tourist operating a Non-Phils. Drivers License beyond 90-day period: PHP 1,500.00.
- The ordinance’s penalty table expressly also covers offenses on: UVVRP, taxicabs without meter/tampered seal, animal-drawn vehicle licensing, lights/gadgets, street diggings/road closure without permit, vehicle unworthiness, unauthorized installation/use of accessories, illegal installation/display of signage, and cellphone use while driving.
Uniform Ordinance Violation Receipt (UOVR)
- The Uniform Ticketing System uses a uniform ticket called the Uniform Ordinance Violation Receipt (UOVR).
- The UOVR contains MMDA, LTO and 17 LGU logos.
- The UOVR contains MMDA and LGU specific serial numbers.
- The UOVR includes common security features to prevent proliferation of fake tickets commonly termed “palipad or talahib”.
Jurisdiction and payment rules
- Existing arrangements on areas of jurisdiction remain effective.
- Fines are paid directly to the Local Government Unit (LGU) for apprehensions made within its jurisdiction, and to MMDA for apprehensions within its jurisdiction.
Authorized apprehending agencies
- Apprehensions may be made by MMDA, Philippine National Police (PNP), the Muntinlupa Traffic Management Bureau (MTMB), and the Tricycle Regulatory Unit (TRU).
- Apprehensions may also be made by other private sectors authorized or deputized by MMDA.
- Apprehensions may be made by other department/agency/office deputized by the City Mayor in black and white.
Separability, repeals, and modification
- If any part of the ordinance is held unconstitutional or invalid, the remaining parts continue in full force and effect under the ordinance’s separability clause.
- All prior ordinances inconsistent with this ordinance are deemed repealed or modified accordingly under the ordinance’s repealing clause.
