Transfer of Personnel, Assets, Liabilities, and Records
- All personnel currently assigned to the school extension are transferred to the new Santos Encarnacion Elementary School.
- All assets owned by the school extension are likewise transferred to the independent school.
- Any liabilities of the school extension shall be absorbed by the independent Santos Encarnacion Elementary School.
- School records maintained by the extension are also transferred to the new independent school.
Funding and Appropriation
- The Secretary of Education is mandated to include the operationalization of Santos Encarnacion Elementary School in the Department of Education's programs immediately.
- Initial funding for the independent school shall be charged against the current year’s appropriation previously allocated for the school extension.
- Subsequent funding necessary for the continued operations of the Santos Encarnacion Elementary School must be included and secured annually through the General Appropriations Act.
Implementation Rules and Regulations
- The Secretary of Education is required to formulate and issue implementing rules and regulations within sixty (60) days following the approval of the Act.
- These rules shall govern the proper implementation of the provisions stipulated in the Act.
Effectivity Clause
- The Act shall take effect fifteen (15) days after its publication.
- Publication must be either in the Official Gazette or in a newspaper of general circulation to ensure legal effectivity and public notice.
Legal Formalities
- The Act was duly approved by the Senate and House of Representatives of the Philippines on their respective dates.
- The President of the Philippines approved the Act on December 10, 2021, making it law.
- Signatories included the President of the Senate, Speaker of the House of Representatives, Secretaries of the Senate and House, and the President of the Philippines.
