Transfer of Personnel, Assets, Liabilities, and Records

  • All personnel currently assigned to the school extension are transferred to the new Santos Encarnacion Elementary School.
  • All assets owned by the school extension are likewise transferred to the independent school.
  • Any liabilities of the school extension shall be absorbed by the independent Santos Encarnacion Elementary School.
  • School records maintained by the extension are also transferred to the new independent school.

Funding and Appropriation

  • The Secretary of Education is mandated to include the operationalization of Santos Encarnacion Elementary School in the Department of Education's programs immediately.
  • Initial funding for the independent school shall be charged against the current year’s appropriation previously allocated for the school extension.
  • Subsequent funding necessary for the continued operations of the Santos Encarnacion Elementary School must be included and secured annually through the General Appropriations Act.

Implementation Rules and Regulations

  • The Secretary of Education is required to formulate and issue implementing rules and regulations within sixty (60) days following the approval of the Act.
  • These rules shall govern the proper implementation of the provisions stipulated in the Act.

Effectivity Clause

  • The Act shall take effect fifteen (15) days after its publication.
  • Publication must be either in the Official Gazette or in a newspaper of general circulation to ensure legal effectivity and public notice.
