Legal basis and compliance framework
- The regulation is issued pursuant to Sections 3.4.3 and 3.4.2 in Amendment 10 of ICAO Annex 17.
- The regulation enforces civil aviation security standards under the National Civil Aviation Security Program (NCASP).
- The appointment criteria exist to support civil aviation security standard procedures mandated under the NCASP.
Purpose and security rationale
- Screening of passenger and cargo is identified as a central civil aviation security measure because it is the highest recorded area of security incident.
- Personnel competence of airport personnel, cargo screeners, and Aviation Security Screeners is treated as paramount for implementing security procedures.
- Each screener must perform functions with ease, speed, and dexterity to discourage and deter acts of unlawful interference.
- The rules are designed to promote civil aviation security objectives under the liberal construction directive in Section 6.
Qualifications for appointment as OTS screener
- Applicants must meet all qualifications under Section 2 to be appointed as OTS-Screener.
- Applicants must be at least 21 years of age and not more than 35 years of age at the time of application for employment (Section 2.a).
- Applicants must have a minimum height of 5a2 for female and 5a4 for male (Section 2.b).
- Applicants must have passed required physical, medical, and Neuro-Psychiatric Examinations in a designated government hospital (Section 2.c).
- Applicants must complete either at least 72 academic college units or attain at least 2nd year college equivalent, accredited by CHED and TESDA (Section 2.d).
- Applicants must not have been convicted of any crime involving moral turpitude (Section 2.e).
- Applicants must have no pending criminal/administrative case (Section 2.f).
- Applicants must have color perception sufficient to use color x-ray equipment and to check passes with color codes and must not be color blind (Section 2.g).
Disqualifications for appointment
- Appointment is disqualified for the persons listed in Section 3.
- A former government employee who was earlier removed for cause is disqualified (Section 3.a).
- A person applying with relatives within the 4th degree of consanguinity is disqualified if applying at the same time (Section 3.b).
- Any person convicted for a crime involving moral turpitude is disqualified (Section 3.c).
- A non-resident alien in the Philippines is disqualified (Section 3.d).
- A person is disqualified if within the 4th degree of consanguinity/affinity of the head of office, appointing authority, recommending officer, and immediate supervisor (Section 3.e).
- The Administrator of the OTS may order additional disqualifications under Section 3.f.
Selection based on allocated points
- Applicant selection uses an allocated points basis under Section 4.

Required formalities and appointment process
- An applicant seeking employment as an OTS screener must first submit a duly accomplished OTS application form #A-11-06 (personal data sheet) in triplicate (Section 5.1).
- The applicant must submit the original copy of the birth certificate, diplomas, citations, and transcript of records (Section 5.2).
- The applicant must submit NBI clearance from previous offices, duly authenticated by the issuing office/agency (Section 5.2).
- The applicant must submit ID pictures: 2 copies 1 x 1 and 2 copies 2 x 2 (Section 5.2).
- The applicant must submit other requirements as the OTS may prescribe (Section 5.2).
- The applicant must undergo personal interview by the Personnel Selection Board (Section 5.3).
- Before final acceptance, the applicant must pass minimum requirements for a complete background investigation, national and local agency check (NAC & LAC), and must be extended a probational appointment for 6 months (Section 5.4).
- Applicants must undergo and pass on-the-job-training while still on probation to comply with aviation security course standards mandated by the NCASP, through attendance in the appropriate sanctioned aviation security training packages (STP), before formal appointment as an OTS screener (Section 5.5).
Priority rules and construction
- When all factors are equal, employment priority is given to orphans of deceased former NACAHT/NCCAS employees, then orphans of deceased PNP-ASG personnel, then orphans of deceased OTS personnel, in that order, provided the applicants meet the qualifications under Rule II (Section 5.6).
- The rules must be liberally construed to promote civil aviation security objectives (Section 6).
- The OTS, through the Administrator, may enforce the rules during inspection, investigation, evaluation, assessment, and audit of the regulated activities and may prescribe other requirements to meet evolving transport security administration challenges (Section 7).
Separability and effect
- If any provision or section of the rules is declared null and void by a competent authority, the remaining provisions and sections remain in full force and effect (Section 8).
- The regulation takes effect immediately after publication in a newspaper of general circulation (Section 9).
