Territorial boundaries and area description
- Section 2 sets the territorial boundaries of Barangay Tagukon as follows:
- Bounded on the North by Barangay Carol-an.
- Bounded on the Northeast by Negros Oriental.
- Bounded on the Southeast (SE) by Negros Oriental.
- Bounded on the Southwest (SW) by Ilog River.
- Bounded on the Northwest by Banga Creek and Inihi-an Creek.
- Bounded on the West (W) by Barangay Camingawan.
- Barangay Tagukon has an area of One thousand nine hundred three and 1509/10000 (1,903.1509) hectares, more or less.
Plebiscite supervision and compliance
- The creation of Barangay Tagukon is treated as complying with the plebiscite requirement under Section 10 of the Local Government Code of 1991, as amended.
- The plebiscite conducted and supervised by COMELEC pursuant to Provincial Ordinance No. 93-002, Series of 1993 of the Sangguniang Panlalawigan of the Province of Negros Occidental is deemed substantial compliance.
- The plebiscite is also tied to the proclamation by the Plebiscite Board of Canvassers.
Incumbent barangay officials continuity
- The incumbent elected barangay officials of Barangay Tagukon continue to hold office.
- Continuity lasts until successors have been duly elected and qualified.
Transfer and administration of public facilities
- All public infrastructure and facilities existing within the barangay at the time of approval of the Act are transferred.
- The transfer is without cost or compensation to the new Barangay Tagukon.
- The transferred facilities are to be administered by Barangay Tagukon.
IRA entitlement under the Local Government Code
- Barangay Tagukon is entitled to internal revenue allotment (IRA) shares.
- IRA entitlement is pursuant to Section 285 of the Local Government Code of 1991, as amended.
Effectivity and publication rule
- Section 7 provides that the Act takes effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
- The Act is approved on July 30, 2022.
- The Act lapsed into law on JUL 30 2022 without the President’s signature, in accordance with Article VI Section 27 (1) of the Constitution.
