Authority and Approval on Land Conversion
- The exclusive authority to approve or disapprove conversion of agricultural lands to residential, commercial, industrial, or other uses is vested in the Secretary of the Department of Agrarian Reform (DAR).
Prohibited Acts Regarding Conversion and Tenant Rights
- Unlawful ejectment of tenant-tillers or farmworkers is prohibited.
- Landowners cannot convert agricultural lands into non-agricultural uses to evade CARP coverage.
- Change in the nature of agricultural lands outside urban centers or city limits is prohibited after the effectivity of R.A. 6657.
Conditions for Conversion of Coconut Lands
- Conversion of coconut lands to other uses is allowed only if the majority of coconut trees are senescent and economically unproductive.
- This condition must be certified by the Philippine Coconut Authority (PCA).
- Affected tenants, lessees, and farmworkers must receive copies of PCA’s findings and recommendations.
- Security of tenure for tenants and farmworkers must not be compromised by the change in cultivation.
- Conversion to non-agricultural uses entitles affected persons to rights and benefits under the law.
Penalties and Enforcement
- Any person or entity that willfully obstructs the implementation of these rules is liable for contempt and other legal penalties.
- Cases should be reported to the nearest Provincial Agrarian Reform Office.
Effectivity and Supersession
- The Administrative Order takes effect ten days after its publication in two national newspapers.
- All inconsistent orders, circulars, rules, and regulations are revoked, amended, or modified accordingly.
