DTI Administrative Order No. 09 establishes regulations for price tags and shelf pricing in retail establishments, ensuring clear pricing information for consumers while allowing the use of modern technology for product identification.

Scope and Coverage

  • Applies to all consumer products offered at retail, except those too small or impractical for individual price tags.
  • Such exempt items must have a price list or poster nearby with detailed specifications.

Requirements for Price Tags and Labels

  • Price tags must clearly state the price, inclusive of VAT and other charges, in pesos and centavos.

Authorized Use of Shelf Pricing

  • Establishments using shelf pricing must:
    • Provide itemized receipts or cash register tapes detailing product description, size, quantity, and price.
    • Install at least one Price Verification Counter or electronic system per floor to supplement shelf pricing.
    • Subject to quarterly BTRCP survey to assess adequacy of Price Verification Counters.

Policy for Non-compliant Establishments

  • Must follow individual price tagging or provide price lists/posters as applicable.

Shelf Pricing Combined with Product Codes

  • Shelf pricing allowed if combined with product identification codes that, when scanned, display the item's price.

Detailed Rules on Shelf Price Presentation

  • Price tags must include retail price, brand name, product description, net quantity (weight, measure, or count).
  • Tags should be placed strategically above or below the shelf.
  • At least one price tag per brand per meter of shelf; fractions require additional tags.
  • Minimum font size: 8 mm for price, 4 mm for other information.
  • Tags must be secured to prevent tampering or loss.
  • Price consistency must be maintained between shelf tags, price verification counters, and registers.
  • In cases of price discrepancies, the lowest price shall prevail.

Penalties for Violations

  • Violations addressed under the Consumer Act of the Philippines and Executive Order No. 913.

Separability Clause

  • Invalid provisions do not affect the validity of other provisions.

Repealing Clause

  • Previous conflicting rules or regulations are repealed or amended accordingly.

Publication and Effectivity

  • Rules to be published in two newspapers of general circulation.
  • Take effect 15 days after publication.
