Rules on Verification of Subdivision Plans
Law
Lra Circular No. 27
Decision Date
Aug 27, 1990
LRA Circular No. 27 establishes rules and procedures for the verification and approval of subdivision plans, mandating timely fee payments, prioritization of processing, and ensuring compliance with access requirements for residential lots.

Law Summary

Assignment and Record-Keeping by Examiners

  • Subdivision plans are assigned to examiners the next working day after receipt.
  • Examiners maintain a record book recording each plan's number, date received, and date finished.
  • Examiners sign the record book page indicating receipt of the plan from the employee who forwarded it.

Verification via Municipal Index Sheet (MIS) Plotting

  • To verify boundaries and prevent overlap or encroachment, subdivision plans are forwarded to the Land Projection Section for plotting on the MIS.
  • Exceptions include:
    • Plans already plotted with certification that no overlap exists.
    • Plans adjoining decreed properties pending ascertainment of adjoining lots' status.
  • Examiners ensure the lot is plotted or properly certified to avoid duplication and overlap.
  • Examination includes stamping plans that are verified as previously plotted and non-overlapping.

Processing Time Frames for Subdivision Plans

  • Land Projection Section must complete plotting within two (2) working days from receipt.
  • Subdivision and Consolidation Division must complete processing and verification within three (3) working days:
    • If no plotting needed, timing is from receipt of the plan from the receiving clerk.
    • If plotting was required, timing is from receipt from Land Projection Section.
  • Plans are processed on a first-come, first-served basis.

Procedural Requirements and Conditions for Approval

  • Subdivision plans must ensure all residential lots have road access.
  • Rights of way must be delineated as separate lots; dotted-line indication alone is insufficient for acceptance.
  • Plans deficient in requirements or containing errors are returned with a letter requesting correction within twenty (20) working days.
  • Failure to resubmit within the deadline results in withdrawal of the plan and forfeiture of fees.
  • Corrected plans are processed anew as freshly submitted plans.

Conduct and Security Measures in the Subdivision and Consolidation Division

  • Parties transacting business are prohibited from entering employee working areas to avoid disturbance.
  • A designated reception or waiting area is provided for visitors and clients.

Amendments and Supplementations

  • This circular amends prior LRC Circular No. 13 (1955), supersedes LRC Circular Nos. 343 (1978) and 359 (1979), and supplements LRC Circular No. 301 (1976) and LRA Circular No. 26 (1990).
  • Strict compliance with Administrative Order No. 172 (1978) prohibiting officials/employees from following up papers and plans is mandatory.

This framework governs the proper verification and approval of subdivision plans under Section 50 of PD 1529, ensuring orderly processing, preventing boundary conflicts, and enforcing procedural discipline in the land registration process.
