Objectives of the Importation Regulations
- Secure uninterrupted supply of affordable finished wood materials for domestic markets.
- Use imported wood materials as a temporary measure until local sources suffice.
- Augment indigenous sources to maximize capacity of wood processing plants.
- Support employment generation and foreign exchange earnings through wood industries and exports.
Eligibility to Import Wood Materials
- Only holders of Timber License Agreement (TLA), Industrial Forest Management Agreement (IFMA), Wood Processing Plant Permit (WPP), or Certificate of Registration (CR) as wood furniture manufacturers, agents, contractors, or dealers may import.
- Importers must have their local permits recorded with Philippine Wood Producers Association (PWPA) and stamped by the Regional Executive Director (RED) as valid Authorities to Import.
- Non-holders of TLA, IFMA, or WPP must secure registration under specific requirements.
Designated Ports of Entry
- Specific ports in Luzon, Visayas, and Mindanao are designated for imported wood materials.
- These include major ports such as South Harbor Manila, Cebu City, Davao City, among others.
- The Secretary of Environment and Natural Resources may designate additional ports if necessary.
Entry and Discharge Procedures
- Importation must comply with Bureau of Customs (BOC) and Bureau of Plant Industry-Plant Quarantine Office (BPI-PQO) procedures.
- Submission of Authority to Import or valid Certificate of Registration is mandatory.
- Phytosanitary Certificate from the country of origin required for inspection.
- DENR technical personnel are available to assist BOC and BPI-PQO upon official request.
Transport Documentation Requirements
- Authority to Import or Certificate of Registration along with BOC clearance suffice for transport from port to destination.
- Upon arrival at destination, importer must provide the Community Environment and Natural Resources Office (CENRO) with copies of key documents: Authority to Import/Certificate, Phytosanitary Certificate, Bill of Lading, and Packing List Summary.
- Monthly import reports to be submitted by CENRO to Forest Management Bureau (FMB) and PWPA.
Storage, Processing, and Disposition Controls
- Disposition of imported materials or finished products allowed within defined areas using sales invoices and delivery receipts.
- Transport outside the defined area or region requires additional documents: Phytosanitary Certificate, inspection report, Bill of Lading, and authenticated Packing List.
Registration of Agents, Contractors, and Dealers
- Applications require company registration documents from DTI or SEC.
- Must have a written agreement with a local principal and a valid supply contract with a foreign exporter.
- Certification from PWPA regarding rationalized import volume is necessary.
- Fees and bonds apply: P500 application, P400 registration, P10,000 cash bond (increased with surety bond).
- Registration valid for one year, renewable.
- Registered entities must display certificate, submit monthly reports, seek import authority before sale, allow inspections, and provide relevant information.
- Clear definitions provided for key terms like agent, contractor, dealer, and commercial poles/piles.
Creation of DENR Forest Quarantine Coordinating Committee (DFQCC)
- Committee chaired by FMB Director and co-chaired by ERDB Director.
- Tasked with developing and monitoring forest quarantine procedures alongside the Department of Agriculture.
Penalties for Non-Compliance
- Possession of imported wood materials in violation results in permits/certificates suspension or cancellation.
- Confiscation of imported materials and derived finished products.
- Forfeiture of required bond.
- Penalties are in addition to other legal sanctions.
Repeal and Continuity
- Repeals previous relevant DENR Administrative Orders (DAO No. 94-17, 97-08, 97-35).
- All inconsistent circulars and instructions are likewise superseded.
Separability Clause
- Invalid provisions do not affect the validity and enforceability of the remaining provisions.
Effectivity
- The order takes effect immediately upon acknowledgement by the UP Law Center.
- Also requires publication in at least two newspapers of general circulation for 15 days.
