Purpose of the Memorandum Circular

  • To provide revised guidelines and procedures for the enforcement of MMDA Resolution No. 02-49, Series of 2002.
  • To ensure the proper application of the "No Physical Contact Policy" with constitutional compliance.

Key Guidelines for Implementation

  • Traffic violators’ images are captured using digital cameras, eliminating physical contact during apprehension.
  • Applies randomly to all motorists/drivers of private and public utility vehicles.
  • A summons or first notice is issued to the violator/vehicle owner/operator, signed by the TOC Executive Director and the cameraman.
  • The summons includes: date, time, location, traffic violation details, fines/penalties, and a photo of the vehicle.
  • Violators have 7 days from receipt to file a protest with the Traffic Adjudication Board (TAB); failure to protest is deemed a waiver and admission of violation.
  • Payment of fines is due within 7 days unless a protest is filed.
  • Payments can be made at METROBANK branches or at the MMDA Central Office Collection Division if a protest is filed.
  • If unpaid and unprotested after 7 days, a final demand is issued; continued non-payment leads to inclusion of the driver’s license or vehicle plate number in an alarm list and vehicle apprehension and impoundment.
  • Summons/notice sent via registered mail through Makati Central Post Office; copies sent daily to Land Transportation Office (LTO) and Land Transportation Franchising and Regulatory Board (LTFRB).
  • Mailing costs charged to violators.
  • Refusal to accept summons without valid reason is considered reception for compliance purposes.

Separability Clause

  • Any part of the circular declared unconstitutional or invalid does not affect the validity of the remaining provisions.

Repealing Clause

  • Repeals or modifies Memorandum Circular No. 5, Series of 2003, Memorandum Circular No. 10 dated October 3, 2003, and other inconsistent issuances.

Effectivity

  • The Memorandum Circular takes effect 15 days after publication in two newspapers of general circulation.
