Purpose and targeted law-enforcement detail
- The circular provides guidelines and procedures for personnel action involving the detail of PNP uniformed personnel to other government offices/agencies.
- The detail covered is limited to cases where the receiving office/agency performs functions related to law enforcement, order maintenance, or conduct of police training.
- The circular sets eligibility standards, approval process, and implementation controls for detail arrangements.
Definitions governing detail arrangements
- “Detail” means temporary movement of a PNP personnel from the PNP to another government office/agency that does not involve a reduction in rank, status or salary and does not involve issuance of an appointment, but requires issuance of PNP orders.
- “Receiving agency” means the agency where the PNP uniformed personnel will be placed on detail.
- “Administrative supervision” means authority to direct performance of duties; restrain commission of acts; and review, approve, reverse or modify acts or decisions of the detailed PNP uniformed personnel.
- “Carrying Unit” means the unit which has functions related or similar to the agency/task force where the personnel is on detail.
Coverage, eligibility, and rank limits
- Police Inspector (PINSP) and Police Officer 1 (PO1) shall not be placed on detail outside the PNP organization.
- The rank restriction for PINSP and PO1 is imposed to avoid affecting overall PNP efficiency and effectiveness in implementing anti-criminality campaigns, counter-terrorism operations, internal security operations (ISO), and crime prevention programs.
- A PNP uniformed personnel must have rendered at least five (5) years of active service in the PNP organization to be considered for detail.
- A PNP uniformed personnel must have very satisfactory (VS) performance in the last rating period to be considered for detail.
- A PNP uniformed personnel must have a permanent appointment in the present rank to be considered for detail.
- A PNP uniformed personnel must have no pending case and must not be a Pre-Charge Investigator or a Summary Hearing Officer to be considered for detail.
- PSSUPT and PCSUPT may be allowed to be detailed outside the PNP organization only to offices/agencies under the Department of the Interior and Local Government (DILG), and the detailed personnel must perform duties/functions equivalent to their ranks.
- Detail outside the PNP organization is allowed only upon satisfaction of all of the following:
- There is a pressing need for the service of the subject uniformed personnel in the requesting office/agency, subject to evaluation by the PNP.
- The duty to be performed must be related to law enforcement, peace and order maintenance, conduct of police-related training, or research development.
- The period of detail is a maximum of six (6) months, renewable for another six (6) months upon request of the receiving agency with concurrence of the concerned personnel, but in no case shall exceed two (2) years.
Approval authority and administrative jurisdiction
- The approving authority for detail of PNP personnel outside the PNP is vested on the Secretary of the Interior and Local Government (SILG) upon recommendation of the Chief, PNP.
- On punctuality, attendance, leaves, and travel, PNP relinquishes administrative supervision over the detailed personnel to the receiving unit/agency responsible for monitoring punctuality and attendance, evaluating performance, and exercising acts necessary to supervise effectively.
- Vacation and sick leaves and authority to travel abroad must be processed through DPRM, upon recommendation of the appropriate authorities of the carrying unit, subject to existing PNP policies.
- On monitoring performance and status:
- Personnel detailed outside the DILG must be rated under the Rating System of the Receiving Agency.
- One (1) Satisfactory (S) rating is a ground for cancellation of the detail order.
- Personnel detailed outside the DILG are not entitled to payment of Productivity Incentive Benefit (PIB) from the PNP during the duration of detail.
- The DPRM is the office primary responsible (OPR) for monitoring implementation and must submit a monthly monitoring and evaluation report on detail status to the Chief, PNP (through DCA).
- The Director, HSS must submit to DPRM every 5th day of the month a monitoring and evaluation report of PNP personnel on detail with other government agencies outside the DILG.
- On disciplinary authority:
- The authority to discipline detailed PNP uniformed personnel remains with the PNP disciplinary authorities subject to NAPOLCOM Memorandum Circular No. 96-010 and other related issuances.
- For administrative cases arising from acts done by detailed PNP personnel in the receiving agency, the receiving agency, in coordination with the PNP, must initiate the filing of complaint in conjunction with NAPOLCOM Memorandum Circular No. 99-006 and other related issuances.
- On promotion:
- PNP uniformed personnel on detail outside the DILG are not considered for promotion during the detail period and within six (6) months from termination of detail.
- Personnel on detail with agencies/offices under the DILG may be extended promotion subject to existing policies and procedures, provided there is an existing vacant promotional position within the PNP and provided 3rd level PCOs on detail who have assumed similar key positions for at least one (1) year are given priority to vacant star rank positions in the PNP upon termination of detail.
- Personnel assignment while on detail is directed as follows:
- Schooling (abroad) — PNP Training Service
- PPSC — PNP Training Service
- UN Missions — PNP Training Service
- PCTC — PNP IG
- Agencies outside DILG — AHO, HSS
- Newly promoted personnel may be allowed for detail only after one (1) year from the date of promotion.
Required documents and step-by-step processing
- The receiving office/agency must initiate the request for detail and indicate the justification why the subject personnel is being requested.
- DPRM must require the concerned personnel to submit the following documents:
- Availability for transfer
- Attested appointment in the present rank
- Latest Individual Performance Evaluation Rating (IPIER)
- Unit clearances, including:
- Money/Property accountabilities
- Certificate of Non-Pending Case (Administrative)
- Certification from the losing unit that the applicant is neither a respondent nor a witness of a case undergoing trial or investigation with local courts and PLEB
- Certification from the losing unit that the applicant is not a Pre-Charge Investigator or a Summary Hearing Officer
- DPRM conducts validation on the merits of the proposed detail and submits recommendations to the Chief, PNP based on its findings.
- The Chief, PNP recommends approval of the detail to the SILG.
- The SILG approves and issues a Department Order.
- DPRM announces the approved detail through issuance of a Letter Order indicating the inclusive period of detail.
- After completion of the detail period, the concerned personnel must be assigned back to the previous office/unit of assignment.
- The personnel must not be allowed to be detailed further to another office/agency within two (2) years upon completion of the last detail.
- Upon termination of detail, the concerned personnel must report back to the previous office/unit within seven (7) calendar days.
- Failure to report within the prescribed seven (7) calendar days is a ground for being marked AWOL, after which the office/unit concerned must inform DPRM (Attn: C, PTD) on the status of the personnel for withholding of pay and allowances by the Director, Finance Service.
- If the concerned personnel opts to be assigned to other PNP offices/units upon termination of detail, the personnel must submit a request to the former office/unit, which must endorse the request to DPRM with the documents and clearances needed for processing the transfer request.
Renewal, transition rules, and termination controls
- The detail may be renewed one (1) month before expiration upon request of the receiving agency with concurrence of the concerned personnel.
- The extended period of detail must not exceed two (2) years.
- Upon effectivity, PNP personnel whose detail has expired must report back to the PNP mainstream unless renewed for justifiable reason.
- Currently detailed PINSP and PO1 personnel must be given three (3) months to continue their detail service or until expiration, whichever comes first, upon approval of this circular.
- The Chief, PNP may terminate the detail at any time in the exercise of proper deployment, placement, and utilization of the PNP and its personnel pursuant to Section 26 of Republic Act No. 6975, with prior notice to the SILG.
- DPRM conducts periodic review of the guidelines in consultation with receiving agencies.
Rescission and effect of inconsistencies
- All PNP policies, directives, and other issuances inconsistent with the circular’s provisions are rescinded or modified accordingly.
- The circular establishes its effectivity based on filing at the University of the Philippine Law Center and the 15-day rule under Executive Order No. 292.
