Scope of Application

  • Applies to all individuals, partnerships, or corporations engaged in:
    • Exploration, development, and exploitation of natural resources (e.g., mining, quarrying).
    • Construction of infrastructure projects such as dams, irrigation systems, roads, and bridges.
    • Similar or related operations affecting natural resources.

Obligation to Restore, Rehabilitate, and Return Environment

  • Entities covered must restore, rehabilitate, and return affected lands, rivers, and natural environments to their original pre-operation conditions.
  • Restoration efforts must be to the fullest extent possible.

Rule-Making Authority

  • The Secretary of Natural Resources is empowered to promulgate rules and regulations necessary to enforce the restoration and rehabilitation requirements.

Repeal and Modification of Conflicting Laws

  • Any existing laws, decrees, rules, or regulations inconsistent with this Decree are repealed or modified to conform with its provisions.

Effectivity

  • The Decree takes effect immediately upon its promulgation on September 19, 1977.
