Legal basis and link to FIT Rules
- Republic Act No. 9513 establishes the legal mandate of the ERC to formulate and promulgate the feed-in tariff system, in consultation with the National Renewable Energy Board (NREB).
- The ERC’s feed-in tariff implementation framework includes ERC Resolution No. 16, Series of 2010, adopting the Feed-in Tariff Rules (FIT Rules).
- The FIT Rules were amended through ERC Resolution No. 15, Series of 2012, dated 19 November 2012.
- The FIT Rules provide for a cost-sharing mechanism for consumers supplied through the transmission or distribution network through a uniform charge known as Feed-in Tariff Allowance (FIT-All) (Section 2.5 of the FIT Rules).
- The FIT Rules require that proceeds from the FIT-All be remitted based on more detailed guidelines to be established by the NREB and approved by the ERC (Section 2.6 of the FIT Rules).
State policy and purpose for FIT-All
- The policy of the State is to accelerate the exploration and development of renewable energy resources, increase utilization, and establish the necessary infrastructure and mechanisms.
- The FIT-All system is designed to accelerate the development of emerging renewable energy resources by enabling collection and disbursement mechanisms for FIT-related costs.
- The ERC adopts and implements guidelines to operationalize the collection of FIT-All and the disbursement of the FIT-All fund consistent with the FIT Rules.
Guidelines adopted and incorporated by reference
- The ERC approves and adopts the Guidelines on the Collection of the Feed-in Tariff Allowance (FIT-All) and the Disbursement of the FIT-All Fund.
- The adopted guidelines are attached as Annex “A” and form an integral part of the resolution.
- The ERC adopts the guidelines after consideration of comments submitted by interested parties and after reviewing revisions made by the NREB.
- The ERC’s adoption covers both (a) collection of FIT-All and (b) disbursement from the FIT-All fund.
Adoption history and consultation trail
- The NREB submitted proposed guidelines on 16 April 2012 for ERC approval and the ERC subjected the proposed guidelines to public consultation.
- The ERC approved initial FITs in a Decision dated 27 July 2012 for electricity generated from biomass, run-of-river hydropower, solar, and wind.
- After several revisions and a series of public consultations, the NREB resubmitted the revised draft guidelines on 19 December 2012.
- The ERC adopts the final guidelines after due consideration of the NREB’s revised draft and the outcome of public consultations.
