Erc No. 24, S. 2013
Decision Date
Dec 16, 2013
The Energy Regulatory Commission (ERC) adopts guidelines for the collection and disbursement of the Feed-in Tariff Allowance (FIT-All) to promote the development and utilization of renewable energy resources in the country.

Questions (ERC Resolution NO. 24, S. 2013)

The Energy Regulatory Commission is mandated under Republic Act No. 9513 (Renewable Energy Law) to formulate and promulgate the feed-in tariff system, in consultation with the National Renewable Energy Board (NREB).

ERC Resolution No. 16, Series of 2010 adopted the FIT Rules; these were amended through ERC Resolution No. 15, Series of 2012.

FIT-All is a uniform charge imposed on consumers supplied with electricity through the distribution or transmission network, as a sharing mechanism for the cost of FITs.

FIT-All proceeds shall be remitted based on more detailed guidelines to be established by the NREB and approved by the ERC.

The NREB submitted proposed guidelines on the collection and disbursement of FIT-All, which were subjected to public consultation and later resubmitted in revised form for ERC approval.

Key referenced dates include: (1) 12 July 2010—ERC promulgated FIT Rules (Res. No. 16, s. 2010); (2) 19 Nov 2012—FIT Rules amended (Res. No. 15, s. 2012); (3) 27 July 2012—ERC approved initial FITs; (4) 16 Apr 2012—NREB submitted proposed FIT-All Guidelines (subject to public consultation); (5) 19 Dec 2012—NREB resubmitted revised draft; (6) 16 Dec 2013—ERC adopted the guidelines.

After consideration of the comments, the ERC deemed it appropriate to adopt and implement the Guidelines on the Collection of the FIT-All and the Disbursement of the FIT-All Fund.

It adopts the Guidelines on the Collection of the Feed-in Tariff Allowance (FIT-All) and the Disbursement of the FIT-All Fund (as attached in an annex).

Biomass, run-of-river hydropower, solar, and wind.

Yes. It states that the NREB subjected its proposed Guidelines to public consultation before the ERC approval process.

It shall take effect fifteen (15) days after its publication in a newspaper of general circulation in the country.

It RESOLVED to APPROVE and ADOPT the Guidelines on the Collection of the FIT-All and the Disbursement of the FIT-All Fund, and it states the guidelines are hereto attached as an annex and made an integral part.

The resolution is signed by the ERC Chairperson and Commissioners (Zenaida G. Cruz-Ducut, Alfredo J. Non, Gloria Victoria C. Yap-Taruc, Josefina Patricia A. Magpale-Asirit). Students should note the official signatories as proof of ERC action and quorum/authority.

It provides that copies shall be furnished the University of the Philippines Law Center–Office of the National Administrative Register (UPLC-ONAR) and all parties concerned.

The policy is to accelerate the exploration and development of renewable energy resources, increase utilization, and establish necessary infrastructure and mechanisms.

It limits the coverage of FIT-All as a cost-sharing uniform charge to electricity end-users served through distribution or transmission networks, tying the obligation to the network-supplied consumer context.
