Staffing and Organizational Structure
- PTPB is tasked with establishing the appropriate staffing pattern and qualification standards under the new organizational structure.
- The revised Organization Structure and Staffing Pattern (OSSP) requires approval from both the PTPB Board of Directors and the Department of Budget and Management (DBM).
- The DBM has a ten-day period from the signing of the Executive Order to review and issue the final OSSP.
Compensation Plan
- The compensation plan for PTPB employees must be comparable to prevailing private sector compensation plans as far as practicable and within legal limits.
- This is consistent with Section 105 of Republic Act No. 9593 (Tourism Act of 2009).
Personnel-Related Movements
- Any personnel changes resulting from the reorganization must adhere to Republic Act No. 6656, which protects security of tenure during government reorganization.
- Implementation guidelines include the Civil Service Commission Memorandum Circular No. 13.
Retirement and Separation Benefits
- Employees of PCVC affected by the reorganization who decide to retire, separate, or leave the service are entitled to separation benefits according to applicable Civil Service laws or other beneficial laws or issuances.
- These separation benefits are in addition to any gratuities and other lawful entitlements.
Incentive and Assistance Package
- PTPB may implement an incentive and assistance package for employees who voluntarily retire or leave within a set period.
- The package may also extend to employees adversely affected by the reorganization, such as those rendered redundant.
- The incentive scheme requires approval from the PTPB Board of Directors and does not preclude benefits from existing laws.
Severability Clause
- If any provision of the Executive Order is declared unconstitutional, the remaining provisions will continue to be effective and enforceable.
Effectivity
- The Executive Order takes effect immediately upon signing on June 16, 2010, by then-President Gloria Macapagal-Arroyo.
