Policy and purpose of reorganization
- The policy is to ensure that integrated and rationalized national, foreign, military, political, economic, social and educational policies, programs, and procedures are adopted for the security of the state under the recitals.
- The order directs the establishment of an agency purposely to formulate and adopt policies, programs, and procedures on matters affecting national security so that presidential judgments can rest on sound advice and accurate information under the recitals.
- The reorganization is designed so that the President may rely on a central body that coordinates and integrates relevant government actions affecting national security under Section 3 and Section 8.
Membership of the National Security Council
- The National Security Council (NSC) is composed of the President, Vice-President, and Minister of Foreign Affairs, under Section 1.
- The NSC membership includes the Executive Secretary, Minister of Labor and Employment, and Minister of Local Government, under Section 1.
- The NSC includes the National Security Director and the Chief of Staff of the New Armed Forces of the Philippines, under Section 1.
- The President may designate other government officials and private citizens to the NSC from time to time, under Section 1.
Executive Committee structure and powers
- The NSC has an Executive Committee composed of the President, Vice-President and Minister of Foreign Affairs, Executive Secretary, Minister of National Defense, National Security Director, and Chief of Staff of the New Armed Forces of the Philippines, under Section 2.
- The President may designate such other members or advisers to the Executive Committee from time to time, under Section 2.
- The Executive Committee reviews national security and defense problems and formulates positions and/or solutions for consideration by the NSC, under Section 2.
- The Executive Committee determines the agenda and order of business of the NSC and ensures that NSC decisions are clearly communicated to agencies involved, under Section 2.
- The Executive Committee advises the President on the implementation of NSC decisions, under Section 2.
- The Chairman of the Executive Committee shall use the facilities and expertise of any government agencies and instrumentalities and shall promulgate rules and regulations governing Executive Committee operations, under Section 2.
Presidential presiding and meeting authority
- The President presides over meetings of both the NSC and the Executive Committee, under Section 4.
- The NSC is allowed to have the President preside in his or her stead (“Provided, that Council to so preside in his/her stead”), under Section 4.
Secretariat, supervision, and appointments
- The NSC has a permanent Secretariat under the supervision and control of the National Security Director, under Section 5.
- The National Security Director is assisted by a Deputy, and both positions are appointed by the President and serve at the pleasure of the President, under Section 5.
- The National Security Director shall attend and participate in meetings of the Cabinet and shall have the privileges of a member thereof, under Section 5.
Secretariat organization and regulatory authority
- The National Security Director, in conjunction with the Minister of Budget and Management, is authorized to organize the Secretariat, prepare its plans, budget, and staff and personnel, under Section 6.
- The National Security Director shall promulgate rules and regulations governing the operation of both the Council and the Secretariat, under Section 6.
- The Secretariat budget and staffing pattern and the rules and regulations governing operations become effective only upon approval by the President, under Section 6.
Core functions of the National Security Council
- The NSC is designated as the lead agency of the government for coordinating the formulation of policies with implications on national security, under Section 3.
- The National Security Director shall advise the President on matters pertaining to national security and, whenever directed by the President, oversee implementation of presidential and/or NSC decisions and policies with national security implications, under Section 7.
- Among its duties, the NSC shall advise the President on integrating domestic, foreign, military, political, economic, social, and educational policies relating to national security so ministries, departments, and agencies can meet national security problems more effectively, under Section 8.
- The NSC shall evaluate and analyze all information, events, and incidents in terms of the risks they pose or implications and/or threats to national security and stability, and recommend appropriate responses and/or actions to the President, under Section 8.
- The NSC shall formulate and coordinate policies on matters of common interest among concerned ministries, departments, and agencies, and shall make recommendations to the President, under Section 8.
- The NSC shall ensure that national security policies adopted by the NSC are implemented effectively and efficiently, under Section 8.
- The NSC shall make recommendations and/or render other reports as the President may direct from time to time, under Section 8.
Support from the National Intelligence Coordinating Agency
- The National Intelligence Coordinating Agency (NICA), whether newly organized or existing, shall give support and assistance to the NSC, under Section 9.
Repeal and transitional legal effects
- Presidential Decree No. 1498 on the National Security Council of the New Society is repealed, under Section 10.
- All other laws, decrees, executive orders, letters of instructions, and like edicts inconsistent with Executive Order No. 115 are repealed, under Section 10.
- Executive Order No. 115 takes effect immediately upon issuance under Section 11.
