Effect of Appeals
- Appeals generally stay the execution of the decision/order appealed from.
- Execution may proceed if otherwise provided by law, executive order, or if the Office of the Secretary directs execution pending appeal, considering the case’s nature and circumstances.
Action on Appeal
- The Office of the Secretary reviews the records of the proceedings.
- It may, on its own initiative or upon motion, allow the submission of additional evidence.
Dismissal of Appeal
- Appeals may be dismissed for failure to comply with orders issued in connection with the appeal process.
Finality of Decision of the Office of the Secretary
- Decisions/orders from the Office of the Secretary become final and executory 15 days after the parties receive a copy.
Applicability of the Rules of Court
- The Rules of Court apply to appeals except when they are inconsistent with this Administrative Order.
Effectivity
- The Administrative Order takes effect immediately upon publication in a newspaper of general circulation.
