DENR ADMINISTRATIVE ORDER NO. 87

: Appeals must be perfected within fifteen (15) days after receipt of a copy of the decision/order complained of.
: The notice of appeal must be filed with the DENR Regional Office which adjudicated the case.
: Filing a notice of appeal with the Regional Office, serving copies upon the prevailing party and the Office of the Secretary, and paying the required fees.
: The movant has the remainder of the appeal period, reckoned from receipt of the resolution of denial, to perfect the appeal.
: The Regional Office shall transmit the records of the case to the Office of the Secretary with each page numbered consecutively and initialed by the custodian of the records.
: Yes, the appeal stays the execution of the decision/order appealed from except as otherwise provided by law, executive order, or if the Office of the Secretary directs execution pending appeal.
: Yes, the Office of the Secretary may receive additional evidence on its own initiative or upon motion.
: An appeal may be dismissed for failure to comply with the orders issued in connection with the appeal.
: It becomes final and executory fifteen (15) days after the receipt by the parties of a copy thereof.
: Yes, the Rules of Court apply when not inconsistent with the provisions of this Administrative Order.
