Legal basis and related issuances
- Civil Service Commission (CSC) Resolution No. 01-0490 requires the creation of a Committee on Decorum and Investigation (CODI) in every agency.
- Memorandum Order No. 266 (s. 2007) created the CODI in the Office of the President to receive and investigate sexual harassment complaints.
- Memorandum Order No. 266-A (s. 2007) extended the authority of the CODI to act as investigator in sexual harassment cases/complaints against presidential appointees and other public officials and employees of the Office of the President.
Purpose of the reconstitution
- The reconstitution under Memorandum Order No. 11 is issued to ensure expedient investigation of sexual harassment cases.
Amended CODI composition and quorum
- Section 2 of Memorandum Order No. 266 (s. 2007) is amended to establish a CODI composed of six (6) members.
- The CODI composition requires three (3) Management Representatives, including one (1) Chairman.
- The CODI includes one (1) Second Level Employees’ Representative, one (1) First Level Employees’ Representative, and one (1) Accredited Union Representative.
- A quorum is established as a majority of the members of CODI for the transaction of business.
Voting rules for findings and recommendations
- In rendering or issuing its findings and recommendation, the CODI must obtain a majority of all CODI members.
- The Chairman votes only in case of a tie.
- When the vote of the Chairman is needed, the tie-breaking mechanism operates only through the Chairman’s vote.
Member term and alternates
- The CODI members serve a term of two (2) years, unless replaced earlier (Section 2-A).
- CODI member alternates may be designated by the appropriate unit concerned to act as member when the principal member is unable to attend a CODI meeting.
Revocation and effect of inconsistency
- All memorandum orders or portions thereof inconsistent with Memorandum Order No. 11 are revoked, amended, or modified accordingly.
- Memorandum Order No. 11 becomes operative immediately upon issuance.
