A law reconstitutes the Committee on Decorum and Investigation (CODI) of Sexual Harassment Cases in the Office of the President, specifying its composition and quorum, to ensure expedient investigation of all cases of sexual harassment.

CSC Resolution No. 01-0490 (Rules on Sexual Harassment) mandated the creation of a Committee on Decorum and Investigation (CODI) in every agency.

Memorandum Order No. 266, s. 2007 created the CODI in the Office of the President, and Memorandum Order No. 266-A, s. 2007 extended its authority to act as investigator in sexual harassment cases/complaints involving presidential appointees in the Office of the President.

It reconstitutes the membership of the CODI in the Office of the President to ensure the expedient investigation of sexual harassment cases.

The CODI consists of six (6) members: three (3) Management Representatives (one as Chairman), one (1) Second Level Employees’ Representative, one (1) First Level Employees’ Representative, and one (1) Accredited Union Representative.

The Chairman is one of the three (3) Management Representatives. The Chairman votes only in case of a tie.

A quorum consisting of a majority of all the CODI members is required for the transaction of business.

CODI member alternates may be designated by the appropriate unit concerned to act as member whenever the principal member is unable to attend.

CODI members serve a term of two (2) years unless replaced earlier.

It amends Section 2 of Memorandum Order No. 266, s. 2007 by restating the composition, quorum, voting rule, alternates, and adding Section 2-A on the two-year term.

Section 2 revokes, amends, or modifies all memorandum orders or portions thereof that are inconsistent with Memorandum Order No. 11.

It takes effect immediately upon issuance (effectivity stated in Section 3).

It justifies the need to adjust/reconstitute CODI membership to ensure expedient investigation of sexual harassment cases.

Quorum requires a majority of all members; with six (6) members, a majority is at least four (4).

The requirement is majority of all CODI members; with six (6) members, that means at least four (4) votes (subject to the Chairman voting only in case of a tie).
