LTFRB Circular: provisional franchise authorities
- Memorandum Circular No. 92-001 authorizes all LTFRB Regional Managers (except NCR) to issue provisional authorities to applicants for franchises.
- Provisional authorities are issued to applicants for the unit/s applied for.
- The provisional authority becomes effective upon filing of the application for a franchise.
- The provisional authority is valid for a period of two (2) months.
- The provisional authority remains in force until the Certificate of Public Convenience has been issued, whichever is shorter.
Temporary operational right upon filing
- Applicants covered by the authorization may operate immediately the unit/s for which they filed their franchise application.
- Operations under the provisional authority continue only for the duration set by the LTFRB authorization: two (2) months or until a Certificate of Public Convenience is issued, whichever is shorter.
Enforcement direction: non-apprehension requirement
- LTO personnel concerned are enjoined to honor the LTFRB authorization.
- LTO personnel must implement the enjoined instruction through non-apprehension of those covered.
- The stated basis is the best interest of the service.
- The memorandum requires compliance through strict observance by all concerned LTO personnel.
