Arturo T. Enrile's Department Order No. 97-1097 establishes a standardized classification system for all public transport conveyances, detailing specifications for various vehicle types to enhance public service and streamline the issuance of Certificates of Public Convenience.

Public Utility Buses requirements

  • Public Utility Buses require a seating capacity of 50 and above excluding the driver and conductor.
  • Public Utility Buses require a Gross Veh. Weight of 6,400 kgs and above and/or 70 kgs/pax.
  • Public Utility Buses must be a coach with entry and exit doors, emergency exits, an optional separate baggage compartment, and tempered glass windows.
  • Public Utility Buses must operate on fixed route services that are regular, limited-stop, or express.
  • Public Utility Buses must provide ordinary or air-conditioned ventilation.
  • Public Utility Buses must have fares based on distance or zonal rates as authorized by LTFRB.

Public Utility Mini-Bus requirements

  • Public Utility Mini-Bus seating capacity must be 30–49 excluding the driver and conductor.
  • Public Utility Mini-Bus must have Gross Veh. Weight of between 4,000 and 6,399 kgs and/or 70 kgs/pax.
  • Public Utility Mini-Bus body must be a mini-coach with entry/exit door, emergency exits, and an optional separate baggage compartment.
  • Public Utility Mini-Bus routes must be fixed routes that are regular, limited-stop, or express.
  • Public Utility Mini-Bus ventilation must be ordinary or air-conditioned.
  • Public Utility Mini-Bus fares must be based on distance or zonal rates as authorized by LTFRB.

Public Utility Jeepneys and operating limits

  • Public Utility Jeepneys must have seating capacity of 12–32 excluding the driver.
  • Public Utility Jeepneys must have Gross Veh. Weight of 2,500 kgs. and above and/or 70 kgs/pax.
  • Public Utility Jeepneys must be Jitney type/AUV.
  • Public Utility Jeepneys may operate on fixed routes (regular, limited-stop, or express) or on variable routes within a specified area as authorized.
  • Public Utility Jeepneys may provide ordinary or air-conditioned ventilation.
  • Public Utility Jeepneys must follow these operating conditions:
    • They may be allowed to carry passengers and/or freight for provincial operations.
    • Operation is discouraged along major arterials in urban areas.
    • Ceiling distance applies unless authorized otherwise: Urban routes a 15 kms and Inter-urban/provincial routes - 30 kms.

Filcab requirements and competition limits

  • Filcab seating capacity must be 7–11 excluding the driver.
  • Filcab requires Gross Veh. Weight of maximum of 2,500 kgs and/or 70 kgs/pax.
  • Filcab body must be a Mini-Jitney/AUV.
  • Filcab may operate on fixed routes (regular, limited-stop, or express) or variable routes within a specified area as authorized.
  • Filcab ventilation must be ordinary or air-conditioned.
  • Filcab fares must be based on distance or zonal rates as authorized by LTFRB.
  • Filcab operating conditions require:
    • They may be allowed to carry passengers and/or freight.
    • They should not compete with higher-occupancy public utility vehicles on the majority of the route.
    • Fifteen km. ceiling distance applies unless authorized otherwise.

Taxi and vehicle/fare conditions

  • Taxi vehicle type must be four or five door automobiles.
  • Taxi seating capacity must be 4 excluding the driver.
  • Taxi routes must have no fixed route within a specified area.
  • Taxi ventilation must be ordinary or air-conditioned.
  • Taxi fare structure requires a minimum rate plus fee per unit distance and unit time.
  • Taxi operating conditions require that no more than four passengers may be carried.
  • Taxi standard color must be White.

Vehicles for Hire and fare approval

  • Vehicles for Hire vehicle type must be a Sedan, Asian Utility Vehicle, Pick-up, Van, Station Wagon or Coach.
  • Vehicles for Hire operate on no fixed route.
  • Vehicles for Hire fares must be charged per engagement plus fee per unit time as approved by LTFRB.

Shuttle service classification

  • Shuttle Service vehicle type must be one of: Sedan, Asian Utility Vehicle, Pick-up, Van, Station Wagon, Mini-coach or Coach.
  • Shuttle Service operates on no fixed route.
  • Shuttle Service ventilation must be ordinary or air-conditioned.
  • Shuttle Service fares must be based on distance or zonal as approved by LTFRB.
  • Shuttle Service requires a basis for granting franchise consisting of a valid contract between an establishment or residents association and a common carrier.
  • Shuttle Service operating conditions require special service to employees or association members only, and it must not pick up passengers between designated terminal.

Tourist transport and accreditation

  • Tourist Transport Services vehicle types must include Sedan, Asian Utility Vehicle, Pick-up, mini-coach, Coach.
  • Tourist Transport Services routes consist of special tour trips, without fixed routes, to/from any tourist area.
  • Tourist Transport Services ventilation must be ordinary or air-conditioned.
  • Tourist Transport Services fares must use rates as approved by LTFRB.
  • Tourist Transport Services operating conditions require:
    • Accreditation by Philippine Tourism Authority (PTA)/Department of Tourism (DOT).
    • No picking of passengers along the way.

School transport requirements and markings

  • School Transport Services vehicle types must include Sedan, AUV, Van, Jitney type, Station Wagon, Mini-Coach or Coach.
  • School transport vehicles must have entry and exit doors, steel grilled windows, and black and yellow stripes at the rear.
  • School Transport Services routes are without fixed route, traveling to/from school premises.
  • School Transport Services ventilation must be ordinary or air-conditioned.
  • School Transport Services fares must be as authorized by LTFRB.
  • School Transport Services require a franchise basis through a valid contract between school and transport provider.

Uniform seating measurements; compliance linkage

  • All public vehicles must have uniform seating measurements.
  • The seating measurements must be in accordance with the implementing guidelines of R.A. No. 4136 as amended and/or other relevant laws, rules and regulations.

Repeal, modification, and transitory operations

  • Rules and regulations inconsistent with the Order’s provisions are repealed and/or modified accordingly.
  • Public transport services with subsisting franchise that may be affected by these guidelines are allowed to operate until the validity of the covering CPC has expired.
  • All vehicles subject of new franchise applications must be covered by these guidelines.
