Purpose and scope
- The order confirms instructions already given on the procedure for completing the basic Prison Records of prisoners who have co-accused in the same case.
- The order applies when several convicted co-accused are committed in the same case and their basic documents are handled for prisoner records.
- The order covers handling of basic prison records within the custody and record files of the Bureau’s receiving/document offices and subsequent forwarding for parole evaluation.
Core record-handling rule for co-accused
- When only one set of basic documents accompanies the commitment of several convicted co-accused in the same case, and that set is placed inside the carpeta of the principal co-accused, a Certification must be placed inside the carpeta of the other co-accused.
- The Certification must be issued by the Chief, IREC or his Receiving Officer.
- The certification must confirm that the basic documents are located in the carpeta of the principal co-accused.
Parole-eligibility handling of documents
- When any co-accused has served his minimum sentence and becomes eligible for parole, the Chief, Document Section must ensure that copies of the basic documents are placed inside the carpeta of the prisoner concerned.
- The copies are placed for evaluation by the Board of Pardon and Parole.
- The rule applies specifically upon the prisoner becoming eligible for parole after service of the minimum sentence.
Coordinating files for parole forwarding
- As much as possible, the carpeta of all co-accused must be tied together.
- The tying is especially required particularly, if they have received similar sentences.
- The tying is to be done when and if the carpeta are forwarded to the Board of Pardons and Parole.
