Escalation and Final Executive Action
- Applications involving questions needing higher determination, or where leave is denied due to service exigencies, must be forwarded through the Commissioner of Civil Service.
- The Chief Executive or Department Head has the final authority to approve or disapprove such applications.
Leave Without Pay Restrictions
- Leave without pay is prohibited if the employee has leave with pay available.
- Temporary employees may be granted leave without pay provided it does not conflict with service needs.
Leave Restrictions During Administrative Proceedings
- Officers or employees facing administrative charges or proceedings are not entitled to paid leave during the pendency of such cases.
Computation of Leave Credits
- Leave credits accrue at the rate of one day of vacation leave and one day of sick leave for every 24 days of actual service.
- "Actual service" encompasses continuous service since permanent appointment, including previously granted leave with pay.
- Leave without pay, except for illness, is excluded from the computation of actual service.
Separation from Service and Leave Verification
- Upon separation, payment of any monies due, including salary or leave benefits, is withheld until the Bureau of Civil Service verifies that the employee did not exceed allowable leave credits.
- Data regarding unreported absences and undertime must be submitted to the Bureau for accurate computation.
Handling of Leave Acquired Before November 29, 1936
- Applications for leave earned before the enactment of Commonwealth Act No. 220 (November 29, 1936) shall continue to be processed by the Commissioner of Civil Service.
Discretionary Leave in Municipal Offices
- Under Commonwealth Act No. 490, municipal chiefs of office have discretion to grant leave to municipal officers or employees.
- Such leave applications generally need not be submitted to the Bureau of Civil Service unless higher authority action is required.
Transfer of Employees and Leave Credit Certification
- When employees are transferred to other bureaus or offices, their first leave application with the new office must be accompanied by certified leave balances.
- The Commissioner of Civil Service shall provide these certified statements to the receiving office and relevant city or provincial treasurers for accurate record-keeping.
- Copies of these statements shall also be furnished to the bureau, office, provincial or city auditors.
Pending Leave Applications
- Leave applications currently pending with the Commissioner of Civil Service shall be returned to the appropriate bureaus and offices for approval according to the new regulations set forth by this Executive Order.
