Question & AnswerQ&A (EXECUTIVE ORDER NO. 73)
Each chief of bureau or office of the National Government, provincial government, and government of a chartered city may approve leave applications of permanently appointed officers and employees under their supervision, provided their services can be spared without detriment to public service, after the words 'By authority of the Department Secretary.'
The application shall be forwarded through the Commissioner of Civil Service for final executive action.
No, leave without pay shall not be granted if the employee concerned still has leave with pay to his credit. Temporary employees may be granted leave without pay as long as it is not incompatible with service needs.
No, those facing administrative charges or proceedings shall not be granted leave of absence with pay for the time being.
Leave is computed on the basis of one day as vacation leave and one day as sick leave for every twenty-four days of actual service. 'Actual service' means continuous service since permanent appointment including any previous leave with pay but excludes leave without pay for reasons other than illness.
No payment of money due (salary, leave, etc.) shall be made until notice from the Bureau of Civil Service confirms no leave with pay has been enjoyed in excess of allowable leave. Offices must furnish data on unreported absences and undertime to the Bureau for proper computation.
Applications for leave creditable to service prior to November 29, 1936 shall be forwarded to the Commissioner of Civil Service for action as before.
Granting of leave to municipal officers or employees is discretionary with the chief of office of the municipality; applications need not be forwarded to the Bureau of Civil Service except when questions requiring determination by the Chief Executive or Department Head arise.
The Commissioner of Civil Service shall provide the new office chiefs and city or provincial treasurers with certified statements of the balance of vacation and sick leave of the transferred officers or employees to enable proper action on future leave applications. Copies are also furnished to the respective auditors.
Applications for vacation or sick leave pending action by the Commissioner of Civil Service were to be returned to the respective bureaus, offices, provincial, city, and municipal governments for approval by the officials concerned under the provisions of this Executive Order.
