Executive Order No. 302 aims to ensure fair procurement practices in the Philippine government by promoting open competitive bidding, fair treatment of suppliers, and data collection for policy improvement.

Approval Authority

  • Levels of approving authority for procurement contracts are governed by existing Executive Orders Nos. 301 and 380.

Procurement Methodology

  • Contracts shall primarily be awarded through public/open competitive bidding.
  • Alternative procurement methods are allowed only when necessary and as prescribed by implementing rules.

Composition of the Prequalification, Bid, and Award Committee

  • Chairman: At least third-ranking official of the agency.
  • Executive Officer and Secretary: Legal Officer of the agency.
  • Members: One regular technical member and at least two provisional members knowledgeable of the project, designated by agency head.
  • Observer: One representative from the Commission on Audit.
  • Private Sector Representatives (Observers): One representative each from the Philippine Chamber of Commerce and Industry and an end-user group or NGO.

Functions of the Committee

  • Conduct the bidding process.
  • Evaluate the bidding results.
  • Recommend the award of contract.

Implementation and Oversight

  • NEDA Board's Committee on Infrastructure (INFRACOM) to formulate and promulgate implementing rules and regulations, subject to Presidential approval.

Repeal and Modification of Prior Issuances

  • Any presidential directives, orders, rules, or regulations inconsistent with this Executive Order are repealed or modified accordingly.

Severability Clause

  • Invalidity of any provision does not affect the validity and operation of other provisions.

Effectivity

  • The Executive Order takes effect immediately upon issuance.
