Purpose: protect the general public
- The circular is issued due to the number of “Hit and Run” incidents involving Public Utility Vehicles in recent months.
- The incidents covered include cases causing death and injury to pedestrians and damage to property of private individuals.
- The Board issues the circular to protect the general public by requiring prompt assistance and reporting after accidents.
Scope: who must comply and when
- The circular applies to all drivers and/or conductors of Public Utility Vehicles involved in accidents.
- The circular applies to accidents that involve victims requiring medical assistance.
- The circular applies to accidents that involve damage to property of private individuals.
- The circular’s operative obligations are triggered after an accident involving a Public Utility Vehicle.
Required immediate actions after accidents
- Drivers and/or conductors must render immediate assistance to the victim/s of the accident/s.
- Rendering immediate assistance requires bringing the victim/s to the nearest hospital for medical assistance.
- In accidents involving damage to property, the incident must be immediately reported to the nearest police station after the accident.
- The required police reporting is for purposes of investigation by law enforcement.
Hit and run consequence and suspension
- Failure to render immediate assistance to accident victims as required is treated as a “Hit and Run” accident.
- Failure to immediately report property-damage accidents to the nearest police station is treated as a “Hit and Run” accident.
- The consequence is the Suspension of Certificate of Public Convenience of the involved unit.
- The suspension period is thirty (30) days.
Supersession and effectivity
- LTFRB Memorandum Circular No. 2006-003 supersedes any and all issuances inconsistent with its rules.
- The circular takes effect immediately upon issuance.
