Legal basis and enabling authority
- Executive Order No. 230 is issued pursuant to the provisions of Commonwealth Act No. 430.
- Executive Order No. 230 is enacted under the authority vested in the President by law.
Department mission and supervision
- The Department of National Defense is charged with the duty of supervising the national defense program of the country.
- The Department of National Defense exercises executive supervision over the Philippine Army.
- The Department of National Defense exercises executive supervision over the Bureau of Aeronautics.
- The Department of National Defense exercises executive supervision over the Bureau of Coast and Geodetic Survey.
- The Department of National Defense exercises executive supervision over the Philippine Nautical School.
- The Department of National Defense exercises executive supervision over the establishment and operation of all radio stations (receiving, transmitting, or broadcasting) other than those maintained by the Bureau of Posts.
Covered agencies and operational transfers
- Executive Order No. 230 transfers the Bureaus, offices, and services enumerated in its supervisory paragraph to the Department of National Defense.
- Transfers are required on November 1, 1939, or as soon thereafter as practicable.
- Transfers must be completed not later than December 31, 1939.
Funding for the Office of the Secretary
- Executive Order No. 230 provides that necessary funds for organizing and establishing the Office of the Secretary of National Defense and maintaining it until the next fiscal year shall come from forced savings in salaries and wages and sundry expenses of the Bureaus and offices of the Office of the President.
- Funds are required to be expended in accordance with a budget to be approved by the President.
Transfer of assets and fiscal adjustments
- Executive Order No. 230 transfers unexpended balances of funds or appropriations relating to the enumerated Bureaus, offices, and services to the Department of National Defense.
- Executive Order No. 230 transfers the personnel, equipment, materials, records, and other properties pertaining to the enumerated Bureaus, offices, and services to the Department of National Defense.
- The Auditor General is required to make the necessary adjustments of the appropriations affected by the transfers.
- The Commissioner of the Budget is required to make the necessary adjustments of the appropriations affected by the transfers.
