Legal basis and organizing authority
- Section 68 of the Revised Administrative Code authorizes the organization of barrios into an independent municipality.
- The organization is carried out by Executive Order No. 185 under the President’s direction.
- Executive Order No. 185 is based on the recommendation of the Secretary of the Interior.
Purpose and organizing mandate
- Executive Order No. 185 organizes the barrios of Sipalay, Maricalum, and Cayhagan, together with certain portions of Bacuyagan, into an independent municipality.
- The independent municipality shall be known as Sipalay.
- Executive Order No. 185 establishes the seat of government of the municipality at the barrio of Sipalay.
Scope: covered areas and territorial division
- Executive Order No. 185 covers the barrios of Sipalay, Maricalum, and Cayhagan and certain portions of Bacuyagan, all within the Municipality of Cauayan, Province of Negros Occidental.
- Executive Order No. 185 creates the new municipality by separating the named areas from the existing Municipality of Cauayan.
- The Municipality of Cauayan shall consist of its present territory minus the territory comprised in the Municipality of Sipalay.
Geographic boundaries of Sipalay
- The municipality of Sipalay has boundaries described in an Index Map of Cauayan Cadastre B. L. No. 193, Province of Negros Occidental, surveyed June, 1924 to July, 1927 by cadastral survey party No. 20-A, Bureau of Lands.
- The boundary begins at a point along the shore in the barrio of Cartagena traversed by North Latitude 9A 50'.
- The boundary runs eastward in a straight line along North Latitude 9A 50' to where it intersects East Longitude 122A 35'.
- The boundary then follows a straight north-to-south line along East Longitude 122A 35' to its intersection with North Latitude 9A 40'.
- The boundary then runs in a straight east-to-west line to where it first touches the shore of Nabulao Bay in the barrio of Bacuyagan.
- The boundary then follows the boundary of municipal waters that Sipalay should have pursuant to Section 2321 of the Revised Administrative Code back to the point of beginning.
Effective existence and start of municipal government
- The municipality of Sipalay begins to exist upon the appointment and qualification of:
- the mayor,
- the vice-mayor, and
- a majority of the municipal councilors.
