Questions (EXECUTIVE ORDER NO. 185)

The barrios of Sipalay, Maricalum, and Cayhagan, together with certain portions of Bacuyagan, all from the municipality of Cauayan, Negros Occidental.

The seat of government is at the barrio of Sipalay.

By reference to an Index Map of Cauayan Cadastre B. L. No. 193, surveyed June 1924 to July 1927, and by the specific geographic coordinates/lines described in the executive order.

A point along the shore in the barrio of Cartagena, traversed by North Latitude 9A 50'.

It runs eastward along Latitude 9A 50' to where it intersects East Longitude 122A 35'; then south-to-north along Longitude 122A 35' to North Latitude 9A 40'; then east-to-west to the shore of Nabulao Bay; then follows the boundary of municipal waters Sipalay should have under Section 2321 of the Revised Administrative Code back to the point of beginning.

The order states that the boundary includes the boundary of the municipal waters Sipalay should have pursuant to Section 2321 of the Revised Administrative Code. This is significant because municipal territorial jurisdiction includes both land area and municipal waters.

It means Cauayan is reduced by the portion ceded to the new municipality; the rest of Cauayan’s territory remains.

Upon the appointment and qualification of the mayor, vice-mayor, and a majority of the municipal councilors.

It sets a condition precedent for corporate/governing existence—without the qualified officials, the municipality has no operational legal life under the executive order.

To provide certainty and definiteness in territorial boundaries; cadastral references help prevent boundary disputes and support enforceability.

It legally separates the specified barrios/portions from Cauayan to create a distinct local government unit with its own municipal authority.

It indicates that only parts of Bacuyagan are transferred/organized into Sipalay; the exact portion is presumably determined by the cadastral map and boundary description.

The Secretary of the Interior made the recommendation; the President (Elpidio Quirino) issued the EO; and the Executive Secretary (Teodoro Evangelista) signed as such.

It reflects the administrative policy of structuring local government units based on statutory standards and administrative recommendations to improve governance and local autonomy.
