Law Summary

Receiving of Impounded Motor Vehicle

  • Apprehending Officer (AO) must fill out the Impounding Receipt of Motor Vehicle (IRMV) validated by the Motor Vehicle Custodian (MVC).
  • AO required to record detailed information: owner and driver information, vehicle description, license and plate numbers, date and time.
  • MVC supervises and orders stenciling of chassis and motor numbers on IRMV.

  • Security guard may receive vehicles during MVC's off duty but must turn them over to MVC at next working day.

Releasing of Impounded Motor Vehicle

  • Release requires presentation of several documents from the registered owner/driver:
    • Official Receipt for fine/penalty (original for verification and xerox copy for filing).
    • IRMV and TOP copies.
    • Endorsement from Assecas Office with "For Release" stamp and signature.
    • TAS resolution copy.
  • MVC retains all documents for filing.
  • Security guard cannot release a vehicle without MVC-approved gate pass.
  • Vehicles are released only until 5:00 PM on weekdays except holidays.

Accountability for Impounded Vehicles

  • MVC and assigned security guard accountable for loss or damage of impounded vehicles/items noted on checklist.
  • Losses due to improper turnover are the responsibility of the apprehending officers.

Submission of Reports

  • MVC must submit daily reports on impounded and released vehicles (LES Forms Nos. 003 and 004) to Chief, LES.
  • Monthly reports on impounded vehicles (LES Form No. 005) and on unclaimed vehicles over six months must also be submitted.

Transfer and Storage Procedures for Unclaimed Vehicles

  • Vehicles unclaimed after one month will be transferred to designated impounding areas like Las Piñas.
  • MVC and security guard, escorted by LES law enforcer, perform the transfer.

Enforcement and Compliance

  • Procedures are mandatory for strengthened control and revenue protection.
  • Strict compliance urged under Assistant Secretary Arturo C. Lomibao's directive dated June 05, 2009.
