The LTO Memorandum outlines strict operational guidelines for the General Services Section to enhance the custody, documentation, and release procedures of impounded motor vehicles, ensuring accountability and compliance with revenue collection protocols.

COA observed that apprehended motor vehicles were being turned over to non–Motor Vehicle Custodian (MVC) of LTO Central Office; some were turned over without an Impounding Receipt of Motor Vehicle (IRMV) and temporary operator’s permit (TOP); and vehicles were being released without charging the required fines/penalties, depriving government of revenues and impounding space.

The apprehending officer (AO) must accomplish the IRMV at the impounding area.

The MVC validates the IRMV and supervises/orders the stenciling/counter-checking of chassis and motor numbers on the MVIR form.

Examples include: owner’s name and complete address; driver’s complete name and complete address; telephone number; license number; DLR number; MV plate number; make of MV; type of body; year model; date and time; and AO’s print name and signature.

The MVC supervises/order the stenciling of the chassis and motor numbers on the MVIR form to counter-check with the AO and ensure any additional violations are indicated in the TOP.

They must record: chassis and motor numbers; vehicle checklist; accessories inside MV; general condition of MV; agency/office; and items indicating the AMV turned over to the person/boxes.

No motor vehicle shall be accepted without an accomplished IRMV and TOP.

The MVC must maintain: the 3rd copy (yellow copy) of IRMV; chassis and motor numbers on the MVIR form; and a Xerox copy of the TOP.

The security guard must receive copies of: IRMV and TOP.

The security guard may be allowed to receive impounded vehicles following procedures 1.2 to 1.3, but must turn over the vehicles on the first office hour of the following working day to the MVC.

The registered owner/driver must provide: (1) Official Receipt for fine/penalty (xerox copy plus presentation of original); (2) IRMV with TOP (xerox copy); (3) endorsement from the Assecas Office (xerox copy) with original stamped for release signed by the Chief, LES/Chief Custodial Section indicating date and time; and (4) TAS resolution (xerox copy).

It prohibits release or allowing exit without a duly approved gate pass from the MVC. The security guard must ensure compliance.

5:00 PM, Monday to Friday except holidays.

The motor vehicle custodian and/or the assigned security guard are accountable for lost/missing impounded motor vehicles, and for items in the impounded vehicle as indicated in the checklist, subject to the stated circumstances.

The apprehending officers (AO/s).

They must submit: (1) Daily report on impounded motor vehicles (LES Form No. 003) with the 3rd copy (yellow copy) of IRMV; (2) Daily report on release of impounded motor vehicles (LES Form No. 004); (3) Monthly report on impounded motor vehicles (LES Form No. 005); and (4) Monthly report on impounded motor vehicles not claimed for more than six (6) months.

To maximize compound use, impounded vehicles not claimed within one (1) month from date of apprehension at the CO compound shall be transferred to Las Piñas impounding area and/or other designated impounding area of the LTO.

The MVC and the security guard, escorted by a LES law enforcer, are authorized to transfer the impounded motor vehicle.
