Jurisdictional Authority and Boundaries

  • The Commissioner of Customs is empowered to redefine jurisdictional boundaries of the Port of San Fernando to accommodate the new District Port of Aparri.
  • The District Port of Aparri (Collection District No. XV) will have jurisdiction over the provinces of Cagayan, Isabela, Batanes, Nueva Vizcaya, Quirino, and other areas added by the Commissioner.
  • The Freeport area under Republic Act No. 7922 is excluded from this district.
  • Subports under this district include the ports of Curimao, Tuguegarao Airport, and Laoag International Airport.

Coordination Between CFZA and Bureau of Customs

  • A Memorandum of Agreement (MOA) must be signed within 30 days by the Bureau of Customs and the Cagayan Freeport Zone Authority (CFZA).
  • The MOA will govern their working relationship and protocols for handling cargo entering or leaving Port Irene, a subport of the District Port of Aparri.

Designation and Organization of Port Officials

  • The District Port of Aparri will be led by a Collector of Customs V.
  • The Collector of Customs V will appoint Deputy Collectors of Customs as necessary.
  • Each subport is headed by Port Collectors supported by Deputy Port Collectors, as designated by the Commissioner of Customs.

Personnel Authority and Management

  • The Commissioner of Customs will determine personnel requirements based on principles of economy, efficiency, and effectiveness.
  • Subject to Civil Service rules, personnel transfers or movements may be ordered to staff Port Irene and support operations.

Funding and Appropriations

  • Initial operating funds for the District Port of Aparri will come from the Bureau of Customs' available funds.
  • Future budgetary allocations shall be included in the Bureau’s budget proposals and subject to standard budgeting and auditing rules.

Effectivity of the Executive Order

  • The order becomes effective 15 days after its publication in the Official Gazette or a newspaper of general circulation.
  • This timing ensures official notice and compliance prior to implementation.
