Questions (EXECUTIVE ORDER NO. 707)

To open and declare the Port of Aparri as a principal port of entry (District Port of Aparri) pursuant to Section 702 of the Tariff and Customs Code, in relation to Republic Act No. 7922 (Cagayan Special Economic Zone Act).

It is opened as a principal port of entry to be known as the District Port of Aparri, also referred to as Customs Collection District No. XV.

Section 702 of the Tariff and Customs Code of the Philippines, as amended.

Republic Act No. 7922, entitled “Cagayan Special Economic Zone and Free Port Act of 1995.”

The Commissioner of Customs, subject to the approval of the Secretary of Finance pursuant to Section 701 of the Tariff and Customs Code.

It has jurisdiction over the entire provinces of Cagayan, Isabela, Batanes, Nueva Vizcaya, Quirino, and other areas that may be added by the Commissioner of Customs, excluding the area covered by RA 7922.

Curimao, Tuguegarao Airport, and Laoag International Airport are named as subports.

Within 30 days from effectivity, the Bureau of Customs and the Cagayan Freeport Zone Authority must enter into a Memorandum of Agreement defining their working relationships and the treatment of all cargoes entering or leaving the freeport zone.

Port Irene is treated as a subport of the District Port of Aparri.

Each subport is likewise headed by Port Collectors, assisted by Deputy Port Collectors of Customs as may be designated by the Commissioner of Customs.

Subject to approval of the Secretary of Finance, the Commissioner of Customs may determine personnel requirements and issue orders—consistent with civil service rules—for transfer/movement of personnel from any Bureau organizational unit to the Port Irene/District Port of Aparri.

They shall be drawn from available funds of the Bureau of Customs.

They must be incorporated into its budget proposals, subject to existing budgeting, accounting, and auditing laws and procedures.

Fifteen (15) days after completion of its publication in the Official Gazette or in a newspaper of general circulation.

Section 2 explicitly states that Collection District XV excludes the area covered by the Freeport created under RA 7922.
