Title
POEA Guidelines on Manpower Pooling Ads
Law
Poea Memorandum Circular No. 09
Decision Date
Jan 24, 1992
Manpower pooling advertisements must be supported by principal requests, prohibit medical examinations for applicants, and require agencies to report applicant status and terminate registrations if no job orders are approved within 90 days.

Purpose of manpower pooling ads

  • The circular issues guidelines for the publication of manpower pooling advertisements.
  • The guidelines apply further to Memorandum Circular No. 16, Series of 1988.

Core requirements for advertisement requests

  • Every request for a manpower pooling advertisement must be supported by manpower requests coming from the principal.
  • Manpower pooling advertisements must be published only under conditions supported by principal manpower requests.

Applicant testing and examination limits

  • No medical examination shall be conducted on applicants responding to a manpower pooling advertisement.
  • No trade test shall be required of applicants responding to a manpower pooling advertisement unless the agency concerned advances the cost of the trade test.
  • The cost advancement condition controls whether a trade test may be required.

Reporting duties to the Employment Regulation Branch

  • All agencies must submit to the Employment Regulation Branch a status report covering manpower pooling arising from the advertisement.
  • The status report must be submitted within thirty (30) days from the date of publication.
  • The status report must state the number of applicants registered per principal and skill category, as advertised.
  • The status report must include the names and addresses of applicants trade tested per skill category and the name of trade testing outfit, if any.

Termination rule after non-approval period

  • If, after a period of ninety (90) days from the date of publication, no accreditation or job order is approved by the Accreditation Branch on any of the principals or manpower requests earlier allowed for the advertisement, the agency must immediately terminate all registration/pooling of applicants for the particular principal.
  • The agency must submit a terminal report to the Employment Regulation Branch within ten (10) days from the date of termination.
  • The terminal report must state the reasons why accreditation or approval of the job order has not materialized despite considerable time.
  • The terminal report must include an inventory of applicants by number four (i.e., as covered in the status report reporting requirements on applicant numbers per principal and skill category, as advertised).
  • The termination and terminal reporting obligations are triggered specifically by the absence of Accreditation Branch accreditation or job order approval within the ninety (90) days window.

Compliance mechanism and forms

  • The circular requires strict compliance with the guidelines.
  • The circular provides that forms are attached for submission requirements under numbers four and five (the thirty (30) day status report and the ten (10) day terminal report).
  • The forms are available at the Philippine Overseas Employment Administration.
