Legal basis and related issuances
- The circular is issued pursuant to Department Order Nos. 2005-34 and 2005-37, which prescribe rules governing the authorization of Private Emission Testing Centers (PETC) and PETC Information Technology (IT) Providers.
- The circular also operates by reference to the DOTC/LTO-IT System used by LTO for emission-test verification.
- The circular expressly supersedes conflicting orders and memoranda by deeming them superseded.
Policy and implementation objective
- The circular mandates mandatory validation of emission testing results through the LTO-IT System on an online and real-time basis.
- LTO requires verification of emission test results at LTO District Offices prior to motor vehicle registration.
- LTO officials and employees must accept only emission test results that are verified and authenticated online and real time under the DOTC/LTO-IT System.
- The validation requirement applies effective January 2, 2007.
System requirement for PETCs
- All Private Emission Testing Centers (PETCs) must be connected to the LTO-IT System on an online and real-time basis.
- Each PETC must connect through its respective PETC-IT Provider.
- LTO-IT System verification and authentication control acceptance of emission test results for registration processing.
Registration-processing guidelines
- The system verifies and accepts only motor vehicles with a Passed emission test result for:
- renewal registration of Private vehicles, and
- renewal registration of Exempt Private vehicles.
- The system accepts validated emission test results only when combined with miscellaneous transactions; otherwise, a rejection letter is generated.
- The system does not validate emission test results of other motor vehicle classifications and does not validate for other type of transactions; in such cases, a rejection letter is generated.
- If the motor vehicle has no corresponding emission record, the system generates a rejection letter.
- The system accepts only emission test results issued by DOTC/LTO Authorized Private Emission Testing Centers (PETC) that are connected to the LTO-IT System online and real-time.
- If the emission test result is issued by a PETC not connected as required or not authorized, the system generates a rejection letter.
Rejection letters and annex references
- The system generates a rejection letter when emission results fail validation conditions.
- A sample rejection letter is referenced in Annex A.
- The list of duly authorized PETC-IT Providers is referenced in Annex B.
- The rejection-letter outcomes apply when:
- the motor vehicle’s classification/transaction is outside the validation scope,
- there is no corresponding emission record,
- the issuing PETC is not authorized and/or not connected online and in real time.
Conflicts, compliance, and effectiveness
- Orders and memoranda in conflict with LTO Memorandum Circular No. RIB-2006-790 are deemed superseded.
- “For strict compliance” is required.
- LTO officials and employees must apply the “verified and authenticated online, real time” acceptance standard starting January 2, 2007.
