Legal basis and licensing framework
- The circular is anchored on Section 4(d) of Republic Act No. 4136, otherwise known as the Land Transportation and Traffic Code.
- The circular also operationalizes the LTO licensing concept of a Permit as defined in Administrative Order No. 84 (AO-DIR-002) as a privilege or authority given by the Bureau to a person qualified to learn to operate a motor vehicle.
- The circular treats the driving instruction and actual driving test required by law as occurring when an SP holder later applies for a driver’s license.
- The circular establishes that, going forward, attendance at a basic driving seminar is a requirement before Student Permit issuance.
Purpose and objectives of the seminar
- The circular requires the mandatory seminar to ensure the Student Permit holder has attended a lecture on basic driving.
- The seminar must include instruction on the identification of and appreciation of the value of traffic signs and signals.
- The seminar must also provide awareness of licensing rules and regulations.
- The seminar must inculcate in prospective drivers right attitudes and their social obligations and responsibilities in operating a motor vehicle.
Who must attend and where it is conducted
- The circular requires all applicants for Student Permit to attend the mandatory seminar/lecture on basic driving before the permit is granted.
- The seminar is conducted in LTO Licensing Centers.
- The seminar is also conducted in LTO District and Extension Offices authorized to issue a Student Permit.
- The circular ties venue authorization to offices authorized to issue a Student Permit.
Seminar conduct and required modes
- The circular requires the lecture/seminar be conducted through verbal instructions with visual aides.
- The circular also allows instruction through audio visual/TV/Power Point.
- The seminar must be structured as a lecture/seminar on basic driving before Student Permit issuance.
Student Permit Seminar Certificate (SPSC)
- The circular requires issuance of a Student Permit Seminar Certificate (SPSC) upon completion of a one (1) hour seminar.
- The SPSC must be signed by the Driving Skills Rater (DSR)/Lecturer.
- The SPSC must be attested by the Head of Licensing Center/District or Extension Office.
- A certified/authenticated copy of the SPSC must be included in the documentary requirements for the Student Permit application.
- The SPSC has no expiry date.
- The holder of the SPSC may attend and/or sit in a seminar/lecture again if the holder intends to gain enough knowledge before converting the Student Permit to a driver’s license.
Penalties and consequences for fraud
- The circular makes the submission of a fraudulent or fake certificate by an applicant a ground for denial of the application for Student Permit and an imposition of penalty.
- If a driver’s license has already been issued, the circular requires confiscation of the license.
- After confiscation, the Office must cause inclusion of the confiscated driver’s license in an alarm list in the IT system.
- The licensee must be properly notified in writing for the surrender of the ID card license.
- The circular imposes a six (6) months suspension on the licensee.
- The six (6) months suspension is reckoned upon the date of surrender of the driver’s license.
