Prohibition on Assuming Duties Without Appointment
- Officials and employees are prohibited from assuming the functions and responsibilities of any position without first receiving a duly issued and signed appointment.
Non-recognition of Services Rendered Absent Appointment
- Any service rendered by a person who was made to assume duties without a formal appointment from the appointing authority will not be recognized or credited by the Civil Service Commission.
Liability of Appointing Authorities for Non-compliance
- Appointing authorities who fail to provide the required appointment copy before assumption of duty will be held personally liable for the salaries that accrue to the appointee.
- This liability is pursuant to Section 65, Chapter 10, Subtitle A, Title I, Book V of Executive Order No. 292.
Payment of Salaries Upon Assumption of Duty
- Individuals who have been issued an appointment and required to assume duties must be paid their salaries immediately upon assumption, even if their appointment is pending approval from the Regional or Field Offices of the Commission.
Administrative Sanctions for Violations
- Any breach of these provisions is a valid ground for administrative disciplinary action against the offending party.
Effectivity
- The circular takes effect immediately upon issuance on 16 June 1992.
