PhilHealth premium funding source
- The funds necessary for effective implementation are sourced from the National Health Insurance Fund of PhilHealth.
- The required funding is earmarked from the proceeds of Republic Act No. 10351 (entitled “An Act Restructuring the Excise Tax on Alcohol and Tobacco Products by Amending Sections 141, 142, 143, 144, 145, 8, 131 and 288 of Republic Act No. 8424, Otherwise Known as the National Internal Revenue Code of 1997, as Amended by Republic Act No. 9334, and for Other Purposes”).
- Funding is provided in accordance with pertinent laws and regulations.
Exclusive PhilHealth packages for PWDs
- PhilHealth must develop exclusive packages for PWDs.
- The exclusive packages must address specific health and development needs of PWDs.
Monitoring, evaluation, and data reporting
- The Department of Health (DOH) conducts periodic monitoring and evaluation of the implementation of Republic Act No. 11228.
- Monitoring and evaluation is done in coordination with the Department of Social Welfare and Development (DSWD), the Department of Labor and Employment (DOLE), the National Council on Disability Affairs (NCDA), local government units (LGUs), other relevant government agencies, and nongovernment organizations.
- The DOH must maintain an updated database on PWDs and their health and development needs.
- The LGUs, PhilHealth, NCDA, and other relevant government agencies must submit their data on PWDs to the DOH.
Implementing rules and regulations timeline
- PhilHealth must promulgate the Implementing Rules and Regulations (IRR).
- The IRR must be promulgated in consultation with the DOH, DSWD, DOLE, NCDA, and the various national leagues of LGUs.
- The IRR must be issued within three (3) months upon the effectivity of Republic Act No. 11228.
Repeal and amendment of inconsistent rules
- All laws, decrees, executive orders, rules and regulations, or parts thereof that are inconsistent with Republic Act No. 11228 are repealed, amended, or modified accordingly.
Effectivity and publication requirement
- Republic Act No. 11228 takes effect after fifteen (15) days from its publication in the Official Gazette or in a newspaper of general circulation.
- The Act was approved on February 22, 2019 and carries the date February 22, 2019.
