Scope and Coverage
- Applies to all Customs Bonded Warehouses (CBWs).
Administrative Provisions
- Clearance for specific CBW-related applications issued by Warehousing Documentation and Records Division (WDRD).
- Applications covered include:
- Renewal of license to operate a CBW
- Requests to increase raw material importations
- Relocation of CBW
- Other activities related to customs warehousing operations
- Multiple offices must collate and submit records of derogatory information regarding CBWs to WDRD within 10 days:
- Various operating divisions (CBWD, PPBWD, MMBWD, GTMBWD)
- Warehousing Inspection Division
- Warehousing Assessment Monitoring Unit
- Law Division of all District Ports
- Liquidation & Billing Division
- Collection Service, Revenue Collection Monitoring Group
- Legal Service, Revenue Collection Monitoring Group
- Customs Intelligence & Investigation Service
- Enforcement & Security Service
- Bonds Division
Procedural Provisions
- All concerned offices must forward lists of CBWs with derogatory records to WDRD within 15 days.
- WDRD to encode this data into a computerized databank.
- Management Information Systems & Technology Group (MISTG) to develop a screening computer program within 20 days to match derogatory records with applicants.
- The program provides the Chief of WDRD access to detailed derogatory information upon positive matches.
- Continuous submission of updated derogatory records to WDRD is mandatory.
- Non-compliant divisions are deemed to hold no derogatory information; failure results in accountability of division chiefs.
- Clearances issued by WDRD forwarded to the head of the Customs Bonded Warehouse Committee’s Technical Working Group for applicant evaluation.
Other Relevant Matters
- For CBWs under provincial Collection Districts, clearances issued by the equivalent unit in the port but final clearance by Chief WDRD.
- Clearance issuance for purposes other than warehousing will be handled by the Director of CIIS under a separate order.
Repealing Clause
- This Order supersedes Section IV.1.2 of CMO 39-91.
- Amends or modifies inconsistent customs orders, memoranda, rules, or regulations accordingly.
Effectivity
- The order takes effect immediately upon adoption.
