The objective is to facilitate the processing of applications related to customs warehousing operations.
This Order applies to all Customs Bonded Warehouses (CBWs).
The Warehousing Documentation and Records Division (WDRD) is responsible for issuing clearances.
Applications for renewal of license to operate a CBW, requests to increase raw material importations, relocation of CBWs, and other activities related to customs warehousing operations require clearance.
Several offices including Operating Divisions (CBWD, PPBWD, MMBWD, GTMBWD), Warehousing Inspection Division, Warehousing Assessment Monitoring Unit, Law Division, Liquidation & Billing Division, Collection Service, Legal Service, Customs Intelligence & Investigation Service, Enforcement & Security Service, and Bonds Division of all District Ports.
The offices must submit the derogatory information within ten (10) days from the effectivity of the Order.
MISTG is tasked to develop a computer program within twenty (20) days from effectivity for screening derogatory records and accountability by matching information with CBW applicants.
Failure to comply is interpreted as having no derogatory information or records; however, if this is untrue, the Division or Service Chief will be held responsible.
Clearances shall still be issued by the equivalent unit/division in the Port under CMO 39-91 and then furnished to the Secretariat, CBWC; final clearance is issued by the Chief, WDRD following the prescribed procedures.
Section IV.1.2 of CMO 39-91 is specifically superseded by this Order.
The Order took effect immediately upon its adoption on January 21, 2003.
