Law Summary
Validity and Terms of the Certificate
- Certificate of Good Standing (CGS) is valid for one year from issuance.
- May be revoked earlier for non-compliance with R.A. 6938, 6939, Implementing Rules, and other laws or circulars.
- The certificate must specify the purpose for which it is issued.
Jurisdiction for Issuance
- Area Cooperative Directors can issue CGS to cooperatives within their Extension Office areas.
- Cooperatives at the inter-regional or national level, including specialized ones (insurance, banks, electric cooperatives), have CGS issued by the CDA Central Office through the Legal Division.
- Certificates for importation purposes are exclusively issued by the Central Office following DOF-CDA Joint Circular No. 1-90.
Reporting Requirements
- Monthly issuance reports of CGS must be submitted to the Legal Division-Central Office by the 10th day of the following month.
- Reports must follow the prescribed uniform format.
Instructions for Filling Out the Certificate
- Include three-letter office abbreviation, certificate type abbreviation (CGS), and the certificate number.
- Complete name and address of the cooperative as per the Articles of Cooperation (address amendments required if different).
- Registration or confirmation number and date, including the CDA office of registration.
- Net surplus amount net of statutory reserve from the Annual Report.
- Total number of members per Annual Report.
- Purpose of certificate as stated in the application.
- Place and date of issuance.
- Name and signature of the issuing Area Director.
Standard Certificate Format
- Certifies cooperative's registration under Republic Act No. 6938 (the Cooperative Code).
- Confirms good standing through submission of required documents and absence of pending administrative cases.
- Details net surplus and membership numbers.
- Specifies validity period and purpose.
- Signed by the issuing Area Director.
Monthly Report Format
- Records date of issuance, CGS number, name and address of cooperative, purpose of issuance, cooperative type, and expiry date.
- Includes a summary count and breakdown by cooperative type (credit, consumer, producer, marketing, service, multi-purpose, union, federation).
This Memorandum Circular takes effect immediately as of October 20, 1992.
