Observed Issues with Investigations
- Investigations of incidents within BuCor have been conducted inconsistently and in a disorderly manner.
- Investigation reports were frequently submitted beyond expected time frames, thus delaying proper resolution.
Mandatory Initial Actions by Prison Guard
- Immediately upon an incident, the first Prison Guard on site with jurisdiction must initiate an initial investigation.
- The guard is required to prepare a Spot Report following a designated format.
- The Spot Report must be submitted to the Investigation Section within three (3) hours from the incident occurrence.
- Copies of the Spot Report must also be furnished to the Commander of the Guard on duty and the Superintendent of the National Penitentiary (NBP).
- The NBP Superintendent will promptly forward a copy to the Director of Corrections.
Role and Timeline of the Investigation Section
- Upon receipt of the Spot Report, the Investigation Section assumes responsibility for the case.
- It must prepare a Progress Report within seventy-two (72) hours of receiving the Spot Report.
- Copies of the Progress Report are to be provided to both the Office of the Director of Corrections and the Office of the Superintendent of the NBP.
Final Reporting Procedures
- A Final Report must be prepared and submitted within one (1) week following the submission of the Progress Report.
- The Final Report should follow the prescribed format.
- The report must include details on the actions taken concerning the case.
Record-Keeping and Compliance
- All case files must be maintained in separate folders to facilitate immediate access and reference.
- The procedure aims to ensure information, guidance, and strict compliance with the investigative process.
Administrative Adoption
- These procedures were formally adopted on May 6, 1994, as signed by Major General Vicente G. Vinaro, Director, Philippine National Police (Retired).
