Declared intent and purposes
- The Resolution recognizes that operators/drivers have been disregarding laws on stalled and illegally parked motor vehicles, contributing to vehicular traffic problems along Metro Manila thoroughfares.
- The Resolution finds that the existing service/towing fee has become insufficient to fund the improvement/upgrading of road furniture and to cover administrative costs in traffic improvement measures, especially towing services.
- The Resolution states that the Metro Manila Council needs to impose a standard service/towing fee to deter violations and to ensure benefits for motorists and commuters.
- The Resolution also aims to address the financial requirement of administrative cost involved in towing and impounding operations.
Standard towing fee rates and structure
- The Resolution requires payment of a standard service/towing fee by any operator/owner of a motor vehicle who illegally parks or stalls the vehicle on a public road, street, or thoroughfare within Metropolitan Manila.
- The fee applies for the following vehicle categories, with a base charge for the first four (4) kms. and a per-kilometer charge for every succeeding km.
- Light Vehicles (Cars, Jeeps and Pick-ups having gross capacity weight of less than 4,500 kilos and below): Php1,500.00 for the first four (4) kms., and Php200.00 for every succeeding km.
- Medium Vehicles (Trucks, Buses having capacity weight of 4,501 to 7,500 kilos): Php2,500.00 for the first four (4) kms., and Php200.00 for every succeeding km.
- Heavy Vehicles (Container vans, Trailers Lorries having gross capacity weight of 7,501 kilos and above): Php4,500.00 for the first four (4) kms., and Php200.00 for every succeeding km.
- For all categories, the per-kilometer reference is tied to the impounding area.
Who must pay and to whom
- The Resolution covers any operator/owner of a motor vehicle, whether natural or juridical.
- The obligation to pay is triggered when the vehicle is illegally parked or stalled on a public road, street or thoroughfare within Metropolitan Manila.
- The fee is payable to government or private entities engaged in towing operation.
Impounding area designation
- The Resolution designates the MMDA impounding area as ULTRA.
- The Resolution authorizes the designation of other areas by the Chairman for impounding purposes.
Effectivity and publication rule
- MMDA Resolution No. 10-29 takes effect fifteen (15) days after its publication.
- Publication must be made in two (2) newspapers of general circulation.
- The Resolution was adopted on 14 December 2010.
