Purpose and Legal Framework

- Complies with RA 10533 (Enhanced Basic Education Act of 2013) concerning curriculum and educational standards.
Separation and Conversion
- Celestino G. Tabuena Memorial National High School - MBPSHS Extension is separated and converted into an independent senior high school named Mercedes B. Peralta Senior High School.
Transfer of Personnel, Assets, Liabilities, and Records
- All personnel, assets, liabilities, and records from the previous extension school are transferred to and absorbed by MBPSHS.
Definitions
- Act: RA 11661 regarding separation and conversion of the senior high school extension.
- Learning Facilitator: Supervises and facilitates learning processes.
- Learning Support Aide (LSA): Collaborates with teachers to support learner progression.
- Non-Teaching Personnel: Employees supporting service delivery but not directly teaching.
- RA 9155: Governance of Basic Education Act of 2001.
- RA 10533: Enhanced Basic Education Act of 2013.
- RA 11713: Excellence in Teacher Education Act.
- School-Based Management (SBM): Decentralization policy to improve outcomes through community and school-level decision-making.

Inclusion in Department of Education Systems and Funding
- MBPSHS shall be included in DepEd's program of expenditures.
- Provision of necessary basic education inputs such as classrooms, labs, library, and other facilities.
- MBPSHS to be integrated into DepEd's management information systems like EBEIS and LIS.
School Head Role and Responsibilities
- Appointment and compensation follow RA 9155 and Civil Service laws.
- Acts as instructional leader and administrative manager.
- Duties include setting vision and goals, implementing curriculum, managing resources, staffing recommendations, staff development, community engagement, and accepting donations.
Personnel Management
- DepEd responsible for creating positions and recruiting teaching and non-teaching personnel.
- Staffing and organizational structures must conform to guidelines from DepEd, DBM, and CSC.
Curriculum Implementation
- MBPSHS to implement the DepEd-designed basic education curriculum based on standards under RA 10533.
Monitoring and Evaluation
- The performance of MBPSHS will be monitored by the DepEd Division Office of Sorsogon City.
- Reports will be generated to ensure the achievement of higher learning outcomes.
Appropriations
- Initial funding taken from previous school's appropriation.
- Subsequent funding included in the annual General Appropriations Act.
Legal Clauses
- Separability Clause ensures remaining provisions remain effective if any part is declared unconstitutional.
- Amendments to the IRR require DepEd Secretary's promulgation and consultation with MBPSHS as applicable.
- Repealing Clause terminates inconsistent DepEd orders and regulations.
- IRR takes effect 15 days after publication in the Official Gazette or a newspaper of general circulation.
- IRR registered with the National Administrative Register at the UP Law Center.
