Reclassification of Leyte Timberland for Disposal

DENR Administrative Order No. 2008-16 is issued pursuant to Executive Order No. 192, Republic Act No. 730, and Commonwealth Act No. 141, as amended.
The order also implements disposition rules relative to lands covered by Republic Act No. 9323.
Land disposition is processed through regular procedures under Commonwealth Act No. 141, Republic Act No. 9323, Republic Act No. 730, and other related land laws.
Any inconsistent orders, circulars, or other issuances are revoked or modified in accordance with this order.

DENR Administrative Order No. 2008-16 establishes implementing rules and regulations governing disposition of the reclassified timberland covered by Republic Act No. 9323.
The rules apply for the “guidance and compliance of all concerned,” directing responsible DENR offices and applicants.
The order operationalizes land disposition through survey, filing, and processing steps aligned with established land laws.

The disposition covered by the implementing rules relates to the parcel of timberland reclassified under Republic Act No. 9323.
The reclassified land is located in Barangay Atabay, Municipality of Hilongos, Province of Leyte.
All public land applications tied to the covered parcel are filed with the specified office located in Leyte.
Disposal and processing must follow the regular procedures under Commonwealth Act No. 141, Republic Act No. 9323, Republic Act No. 730, and other related land laws.

The Land Management Services (LMS) of DENR Regional Office (Region 8) must conduct the delimitation survey of the area subject of disposition.
The delimitation survey must be conducted within 15 days after the effectivity of DENR Administrative Order No. 2008-16.
The survey requirement is a condition for implementing the disposition process under the covered land rules.

All public land applications for the covered parcel must be filed with the Community Environment and Natural Resources Office (CENRO), 5th District Baybay, Leyte.
The filing requirement applies specifically to applications concerning the parcel located in Leyte.
The CENRO specified is the receiving office for applications under this implementing framework.

DENR Administrative Order No. 2008-16 revokes or modifies orders, circulars, and other issuances that are inconsistent with its provisions.
The revocation or modification operates “accordingly,” ensuring conformity with the implementing rules for disposition of the covered land.
