Authorized Authority and Scope of Sale
- The Undersecretary for Environment and Research is authorized to handle all matters regarding the sale of exotic animals.
- Sales are generally limited to animals that exceed the carrying capacity of Calauit Island and similar projects.
- Sales may also be allowed if the species’ reproductive rate is stable to maintain population.
- Quarterly updates of species and numbers available for sale will be provided by DENR-PAWB.
Conditions and Restrictions on Sale
- Animals that are in heat, pregnant, nursing young, or dependent on parents cannot be sold.
- Only animals in good condition shall be sold.
- Animals sold must be weaned or independent from parents, with age depending on buyer’s needs.
Supervision and Methods of Sale
- A panel consisting of representatives from DENR, PAWB, Commission on Audit, and an appropriate NGO will supervise sales.
- Sales may be conducted via negotiated sale or sealed bidding, as decided by the panel.
Responsibilities of Selling Party
- The seller is responsible for capture, housing, acclimatization, crating, and shipment costs.
- Quoted price should include CIF (Cost, Insurance, and Freight); FOB quotations are also allowed.
- Capture and transport methods must minimize injury to animals.
- Terms on mortalities during transit must be agreed upon before sale.
Terms of Delivery and Acceptance
- Acceptance of animals occurs at the source to avoid rejection after shipment.
- Animals rejected after sale and shipment are final and cannot be returned or exchanged.
Pricing and Payment Terms
- Sale prices must align with current international market prices.
- Foreign buyers pay in US Dollars prior to shipment.
- Local buyers can pay in US Dollars or Philippine Pesos equivalent.
- Transactions require an irrevocable Letter of Credit opened before capture.
Proceeds and Reporting
- Net proceeds from sales must be reported to DENR through PAWB.
- All proceeds accrue to the National Treasury.
Buyer Qualifications
- Buyers must be recognized local or foreign scientific, research, or zoological institutions with expertise and proven track records.
- Registered government institutions or private organizations recognized in wildlife research and management qualify.
- Private individuals who own registered private zoos or animal collections and demonstrate expertise and financial capability qualify.
Effectivity and Supersession
- The order takes effect immediately upon adoption.
- It revokes and supersedes any inconsistent prior orders.
